FasciaBlaster Class Action Says Cellulite Tool Led to Health Problems

A proposed FasciaBlaster class action lawsuit is raising accusations of false advertising and online harassment against the marketer of a line of cellulite massage products.

Ten plaintiffs from across the country say they suffered an extraordinary array of physical injuries and chronic diseases after using FasciaBlaster massage products marketed by defendant Ashley Black and her group of companies.

When the plaintiffs reported their experiences in online forums, they claim they were met with an aggressive campaign of cyber-bullying.

They believe this online harassment was orchestrated by Black herself.

FasciaBlaster is a brand of massage tools with groups of plastic, finger-like projections. Different FasciaBlaster products come in different sizes and with different features. A two-handle model retails for $89.

According to this proposed FasciaBuster class action lawsuit, defendant Black promotes the FasciaBuster products as a way to reduce the appearance of cellulite. All 10 plaintiffs recount stories of extraordinary health problems they say arose after they used FaciaBlaster products.

Plaintiff Emily Elson says she suffered a flare-up of her Epstein-Barr virus symptoms after using a FasciaBlaster in March 2017. She believes use of the FasciaBlaster “released and reactivated dormant virus cells which had previously been trapped benignly within e.g. subcutaneous fat cells.”

Elson alludes to reports from other FasciaBlaster users who allegedly had similar recurrence of Epstein-Barr, shingles, and Lyme disease episodes after using a FasciaBlaster. She also reports problematic swings in reproductive hormone levels at a time when she was trying to get pregnant.

Plaintiff Stacy Haavisto says that after purchasing and using $500 worth of FasciaBlaster products, she suffered “constipation, Irritable Bowel Syndrome, gas pains, heart palpitations, insomnia, anxiety, difficulty concentrating, blurred vision, vertigo, and severe headaches every day upon waking.”

Haavisto also alleges her FasciaBlaster use caused her to gain 13 pounds. She says she discontinued use of her FasciaBlaster products for a few months while she attempted to lose weight. But upon resuming use of her FasciaBlaster, she claims, she promptly regained eight pounds.

Haavisto and plaintiff Julia Lefebvre say they were targets of harassment and cyber-bullying when they posted about their experiences in a FasciaBlaster Facebook group. Both women say they were attacked by a group member using the name Sarah Minow, who encouraged other group members to attack the plaintiffs with negative online reviews of their businesses and threats of criminal and civil legal action.

The plaintiffs believe the Sarah Minow profile is a fake, as it has no friends, photos or posts and is a member of only one Facebook group, a FasciaBlaster forum. Other plaintiffs report similar experiences of being harassed and kicked out of Facebook groups after they posted negative comments online.

A representative for Ashley Black gave the following statement to Top Class Actions: “Based upon the small number of plaintiffs and the lack of commonality in the various unsupported claims, ADB feels confident that the class cannot be certified. Additionally, these were not personal injury complaints. The plaintiffs had various issues with business practices.”

The 10 plaintiffs propose to represent a Class that would include all persons who have purchased or used FasciaBlaster at some point prior to resolution of this FasciaBlaster class action lawsuit.

They are asking the court for an award of punitive and statutory damages and for compensatory damages to cover lost income and future medical and aesthetic remedies. They also seek injunctive relief that would require Black and her companies to amend their promotional materials, offer full refunds, and post a personal video apology to anyone who reports being maligned or intimidated online.
