experian class action lawsuit

Experian faces a class action lawsuit over accusations that the credit disclosure company violated the Fair Credit Reporting Act.

Plaintiff Michael Dreher alleges that he requested a copy of his credit score from Experian and received a report that included information from Advanta Bank and Advanta Credit Cards account — credit accounts that had been opened by Advanta Bank.

Dreher claims that these accounts were reported to Experian by CardWorks Servicing because the government closed Advanta credit reporting on Mar. 19, 2010.

According to the class action lawsuit, Experian violated federal law because the FCRA requires credit bureaus to disclose the sources of reported credit information.

Experian denies all claims by arguing that listing Advanta Bank or Advanta Credit Cards as the source of information was indeed accurate because it was reasonable under the circumstances of the governmental closing of that account.

Who’s Eligible

If approved, Class Members will include all U.S. residents who requested a copy of their consumer disclosure from Experian on/after Aug. 1, 2010 and received a document in response that identified “Advanta Bank” or “Advanta Credit Cards” as the only source of the information.

I have had many issues with Experian.

  2. Stephanie McDaniel says:

I just found out tonight that there was a victim of at least 2 data breaches. Please add me!!!!

  3. Towanda Smith says:

I have been working on repairing my credit at a cost of $119.95 monthly since May 8, 2017. My negative items is the same with all three credit bureaus. But, for some strange reason I have no negative items deleted with Experian. Can somebody help me understand?

  4. Rs says:

I have been paying 24.00 a month for the past 14 months for Experian score. They are horrible with updates and changing information that is not correct. Now I have called them 4 times and been on hold for 20 minutes each time and then I hang up with frustration. I had to change my bank card to stop them from charging me again this month. They are indeed corrupt.

  5. Jack Schafer says:

We the consumers, are basically at their will and call. They can post a number that destroys our credit, and no-one or nothing is responsible for the outcome or effect.
I go to credit carma to find I’m in the high 700’s, and then Discover tells me my score is in the mid-600, according to experican and FICO.
We the consumers are like slaves to these companies, and we have no control over their practices. To even dispute them costs a monthly fee to actually see their reporting information, or a series of dead end roads, that leads you no-where.
Join this class action suit… and start another… and another…

  6. Heidi Dale says:

I am infuriated with Experian. I have perfect credit, and if there is anything that resembles an error on my tri-reports, I nip it right away. Experian has reported some wrong information which is changing my credit score.

I notify the other two credit companies, whom, immediately rectified the error on my report.

Experian said they did not recognize me etc etc…. just bull. My disputes are simple–satisfaction eons ago of 3 debts. Both other credit agencies have removed them. I have since bought a home and can get any credit that I want. However, Experian is keeping my score from being perfect. Even through Credit Karma, this Experian make you fill out your entire credit history prior to any dispute.. But, they will not let you continue…saying that you are not recognizable in their history? They are making me have to spend time that I don’t have on dealing with them..

EXPERIAN – THEIR GOAL AND BUSINESS PURPOSE IS TO KEEP YOU AS LOW AS POSSIBLE WHETHER ACCURATE OR NOT SO THAT LENDING INSTITUTIONS WILL USE THEIR INACCURATE LOWER SCORES TO BASE THE LOAN ON AND THUS GET A HIGHER RATE!!!

  7. ROBIN OWENS says:

I hate experian, they refuse to update the information.

  8. Stacy Wright says:

    Greetings Everyone,

I’m in the process of filing a Class Action Lawsuit against these “CLOWNS” I mean the Three Credit Bureaus. I’m PISSED that people who have Multiple Bankruptcies, Multiple Foreclosures & Multiple Repo’s have a high Credit Score! I have a few lates and my score drops over 200 points.

When you call them they don’t take accountability, They are trained to make up outlandish stories reasons about why the scores are low. It is a complete SCAM and the whole process needs to be fixed because it is and has always been broken!

Let’s face the true reality that it’s BIG BUSINESS the Credit Bureaus are in the market of destroying lives and selling “Credit Monitoring” as if they’re helping you fix the problem that they’ve created. Our entire lives are built around a system that has no rules or REGULATIONS! Who in the hell is providing them with Policies and Procedures that protect consumers?

Anyone interested in joining me please feel free to reach out.

    1. John says:

“…selling “Credit Monitoring” as if they’re helping you fix the problem that they’ve created.”

I’ve paid them more than $100 for their stupid “Credit Monitoring” because my wife didn’t realize she was opting in for it when she pulled her annual credit report. They made that very easy to do. Cancelling it on the other hand, is not that simple. Best of luck with that lawsuit!

    2. ROBIN OWENS says:

I’m very interested, my score dropped because of one late payment. And my other month’s of on time payments were not recorded

  9. Alice Chewning says:

Experian is extremely lazy in all details. I have constantly told them about University of Phoenix in Phoenix Arizona in a Class Action Suite and they continued to put this on my credit. I will continue to get this dismissed. UOP is illegal in these transactions and Experian is very very lazy in all levels.
