A class action lawsuit argues that the manufacturer of Essentia bottled water uses misleading information on the labels to encourage customers to pay a premium price.

Lead plaintiff Keith Kennedy says that his Essentia water class action lawsuit is based on deceptive claims made by the bottled water company.

The claims lodged in the Essentia water class action lawsuit explain that the products are marketed to consumers as offering “superior hydration” in comparison to other bottled water products.

The Essentia water class action lawsuit explains that some of these claims include statements such as “ionized hydration,” “overachieving H20,” and “9.5 pH or higher.”

The marketing material and information on the bottles says that the water inside is too pure to be tested by any pH strips and claims that the Essentia product is better than all competitors because it turns any source of water into “supercharged” alkaline and ionized water.

The Essentia water class action lawsuit alleges that the company uses these marketing taglines and a logo that appears to have elements linked to the Swiss Army knife logo and the Red Cross in order to give consumers confidence in the product.

As explained in the Essentia water class action lawsuit, this information leads consumers to believe that they can trust that the scientific claims made by the company are backed by research.

The Essentia water class action lawsuit says that a reasonable consumer would believe that Essentia is a better and more effective product for delivering hydration than competitors.

The plaintiff alleges that in order to achieve the benefits touted by the company, a buyer of the water would have to consumer significant amounts, but that no reasonable consumer would know this based on the current marketing.

In particular, concerns are raised regarding claims made by Essentia about blood viscosity and its connection to the product named.

The explanations provided in the Essentia water class action lawsuit state that global health organizations promote rehydration solutions that contain electrolytes and sodium to fight off deadly dehydration.

The allegations against Essentia point out that the connection between alkalinized water in the company’s study and a resulting reduction in blood viscosity is negated due to stomach acids and claims that it is instead electrolytes that allowed the water to be better absorbed by the body.

The class action lawsuit against Essentia says that the company is making false and misleading statements to consumers to encourage those buyers to pay a premium price for bottled water products without appropriate scientific evidence to support the claims made.

The Essentia water class action lawsuit seeks to represent Class Members in New York who purchased Essentia water products during the statutes of limitation.

The lead plaintiff requests certification as a class action, permanent and preliminary injunctive relief, monetary damages and interests, and costs and expenses.

The plaintiff is represented by Spencer Sheehan of Sheehan & Associates PC and Joshua Levin-Epstein of Levin-Epstein & Associates PC.

    We also feel entitled to the law suit
    Against the essential water company.
