EA Football Video Game Class Action Settlement Checks On the Way
By Matt O’Donnell
UPDATE: Payments went out to Class Members in late October 2013. Congratulations to our Top Class Actions readers who submitted a valid claim and got PAID!
A federal appeals court on Friday dismissed an appeal of the EA football video game settlement that was delaying payouts of the $27 million class action lawsuit settlement. Settlement checks will be distributed soon to Class Members who filed a valid Claim Form.
The EA football video game settlement was approved by the Court on May 30, 2013, but an appeal was filed on June 28. The Class Member who filed the appeal, Aaron Miller, had objected to the legal fees being paid out of the settlement fund, which amounted to $7.29 million — or 27 percent of the total fund. His objection was dismissed since the court’s guidelines stipulate that the fees should comprise no more than 30 percent of the fund.
Miller decided to appeal the dismissal of his objection to the federal Ninth Circuit Court of Appeals. On August 16, the appeal was dismissed.
The class action settlement will resolve claims that EA violated antitrust and consumer protection lawsuits by holding exclusive license agreements with the NFL, NCAA and AFL to market branded football video games. The alleged deal drove out competitors and enabled EA to price-gouge consumers, including by charging 70 percent more for “Madden NFL,” according to the 2008 class action lawsuit.
Class Members who submitted a valid Claim Form by the May 15, 2013 deadline can expect to see checks in the mail soon. Checks will range from $5.85 to $162.96, depending on which game(s) they purchased.
Top Class Actions has been following the EA football video game litigation since the class action lawsuit was certified in 2011. Congratulations to our readers who submitted a valid claim and will receive payouts. We would love to hear how much money you received from the class action settlement in the comment section below.

Not sure why everyone is freaking out. I don’t see why someone would lie about getting the check. It isn’t funny if so.
Maybe they’re coming soon, maybe in the next few weeks… It will come.
WHO IS THIS MIKE #24? WHAT KIND OF CHECK DID HE GET FOR $90.00? UNBELIVEABLE, FOR TCA TO PUT THIS OUT THAT THE CHECKS ARE IN THE MAIL.
That is the exact same email I received back from them about 3 weeks ago and also the same one I received today. So I guess they just keep telling everyone to check back in 2 to 3 weeks, looks like a form letter. I can’t believe that TCA doesn’t verify the info first before posting such a major announcement.
EDITOR’S NOTE – We typically confirm with the settlement administrator, or through other trusted sources (like the plaintiff attorneys) before we post an update like this. We’re digging into it and will post an update. I apologize for any confusion! -Scott
I got this email yesterday , At this time a date for the disbursement of payments has not been established. You may contact us again within 2 to 3 weeks for a status update.
