Dish Network LawsuitAt the end of 2014, Dish Network LLC was hit with a class action lawsuit for allegedly charging consumers “tens of millions of dollars” for satellite programming, a service which Dish allegedly failed to provide to paying customers.

Plaintiff Neil Stokes, a resident of Missouri, has filed this Dish Network class action lawsuit, seeking “actual damages, injunctive relief and declaratory relief arising out of DISH’s failure to provide to Plaintiff and the Class monetary relief, such as a credit, rebate, or reimbursement of the tens of millions of dollars paid to DISH by Plaintiff and the Class, for satellite television programming which DISH failed to provide.”

Stokes has been a subscriber of Dish Network satellite programming since 2008, at which point in time he selected and paid for the “America’s Top 120” package, which originally included Turner Programming and Fox News Programming. The plaintiff’s programming package selection was later confirmed by Dish Network and he continued to pay for this service from 2008 through 2014.

However, Stokes alleges that the company’s confirmation did not disclose to plaintiff or other Class Members that Dish Network may at any time during the subscription period, “delete or change any of the programming paid for by the Plaintiff and the Class, or change the pricing of such programming, without any credit, recourse, or recompense to Plaintiff and the Class,” according to the satellite programming class action lawsuit.

On Oct. 21, 2014, the carriage agreement between Dish Network and Turner Broadcasting System Inc. expired, a fact that Dish was allegedly aware of prior to October 2014. On the expiration date, Dish Network made the conscious choice to not renew the Dish/Turner agreement, according to the Dish Network class action lawsuit. From Oct. 21 through Nov. 20 2014, Dish did not provide paying consumers, like Stokes, with their full Dish satellite programming package.

Similarly, on Dec. 21 of the same year, the carriage agreement between Fox News Programming expired, something that Dish was completely aware of prior to December, according to the Dish Network class action lawsuit. In December of last year, Dish Network decided not to renew the Fox contract, and as a result, Dish Network has not provided the previously included Fox channels to Stokes and other Class Members from December to the present.

According to the Dish Network satellite programming class action lawsuit, Stokes alleges Dish Network:

“(a) failed to provide the Turner Programming [and Fox News Programming] to Plaintiff and the Class; (b) pocketed the millions of dollars paid by Plaintiff and the Class to DISH for such programming; (c) refused to provide to Plaintiff and the Class a full credit and/or reduction in DISH’s monthly fees or any other monetary relief; and (d) refused to permit Class members to terminate their Subscriber Agreements without payment of a termination fee to DISH.”

Stokes further alleges Dish Network continues to advertise their satellite programming packages, claiming they include Fox News Channels, despite the contract termination.

The satellite programming class action lawsuit brings several allegations against Dish Network, including claims of breach of contract, breach of covenant of good faith and fair dealing, unjust enrichment, Colorado Consumer Protection Act, Missouri Merchandising Practices Act, and declaratory relief.

In this Dish Network class action lawsuit, Stokes is seeking to represent himself and a proposed National Class and Subclass of similarly situated Dish Network satellite programming consumers. He is seeking relief in the form of Class and subclass certification, individual actual damages for Stokes, aggregate actual damages for the Class and subclass, disgorgement of profits by Dish Network for programming not provided, punitive damages, among other forms of injunctive relief for the plaintiff and the Class.

    Dish is a terrible company ..everytime I get off phone with customer service I am in tears..they constantly change programming and Bill is never the same, my contract up in two months can’t wait to end it..would love to be in on a class action law suit

    Dish network is terrible, every time I call customer service I hang up on tears, they r constantly taking channels off and on…i have no idea what I’m paying for but it is a lot and different every month..maybe ten channels that I actually can watch..my contract up in two months thank GOD…WILL NEVER use Dish again..would love to b in on the class action lawsuit

    I am look to join a CLASS ACTION LAWSUIT AGAINST DISH! I am so ill over Dish, I can bite nails! Dish bills a month in advance even when you have paid your bill in full. Meaning you pay your current bill and the advance bill to a zero balance. On your statement it will say Payment Due..give you your day of the week, date of the month and dollar Amount Due. Dish will take the month in advance again on your next statement and say this is Previous Bill amount plus add your current amount that is due on this statement and in Payment Due…Immediately and in Amount Due now you have two payments due again. This has been a cycle with Dish for years. I want to get some of my money back from Dish and I know the only way I will be able to do that is to sue them. So, if anybody is out there and know of a lawsuit that is going on right now with Dish. It will be greatly appreciated if you can contact me via email. azephyr55@gmail.com

      Yes. I’ve had dish since 2012 to current. About a few months ago I called stating that my bill is always saying I haven’t payed, or I’m late? My bill is around $85 per month. I pay $100 due to the bill always showing late. Come to find out that they had been charging me late fees for almost two years and never told me?? What?? This is got to illegal. So who ever helped me gave me a credit of like $60. To keep me happy. But charged me late fees for two years and disconnect my cable on several occasions and then charged reconnecting fees time after time. That’s not right.

        I too have Dish. Late fees are listed on your monthly statements. You haven’t looked at your monthly statement for 2 years? Even if you’re on auto pay you could get a copy of the bill on the websites or in your email.

    They are crooked! I will never do one of their 2 year contracts again! They say contract I say it was a verbal agreement over the phone. They start jacking up your bill $5 here $10 there when you call them about it they say “It says in the contract that we reserve the right to change your bill and programming at any time.” And then they have the nerve to have you pay for insurance on their equipment! They need to insure that someone doesn’t shove their equipment right up there mailbox.

    I got disconnected after calling to ask for a 2 day extension because I’m on a fixed income and get paid once a month on the SAME day but was refused and they terminated my service! In the past when I asked for a extension I was told I had to downsize to get it so I was left with about 20 Chanel’s for 3 days…..Then a different time I was told we had to drop our remote insurance in order to get an extension. I’m fed up and changing to another company… But they shouldn’t be allowed to do this and also they always REFUSE to let you speak to a supervisor

    I was put in a class action lawsuit and I moved from the place I was living for about 13 years and I was with dish Network from 2002to2013 . And I am not sure what happened to the law suit. The address I was living at is . 8036 E US HWY 40 Effingham IL 62401

    I’m in Miami and my rights have been violated as well not to be able to watch and listen to FOX because DISH took it down. We the people do not want sensoring! I want into the lawsuit as well.

    In some ways, I could just copy and paste many of the above replies. We had DISH. It charged our credit card different amounts every month – amounts that did not even match the amount due and then the next month would show the difference was past due. When we asked for an explanation, we were told, in essence, that the representative could see there was a problem but he did not know what it was and besides, we had to pay anyway. We disputed the overcharge. DISH canceled our contract and tried to charge us $400+ for an early termination fee. We reconnected to keep from having to pay that then were told, oh, by the way, you cannot have the same package and plan as before. The same package would cost significantly more. Then, DISH’s usual happened to us. Negotiations between it and a local station failed and we disconnected. We were told – read your contract, we can do what we want when we want and you still have to pay. Now, it is billing me over $400 for an early termination fee and is not crediting the last credit card payment. In reality, it owes me money. ARGH! WHY on earth are we all still talking about this conduct – nearly two years later. DISH has a gun to the head of many consumers. How can this conduct be allowed?
