A New Jersey dentist has filed an Unum claim denial lawsuit after the insurance giant allegedly wrongfully denied him his Unum disability benefits.
The doctor alleges he was denied his due Unum disability benefits despite meeting all eligibility requirements and filing all necessary records.
The doctor claims he was denied Unum disability benefits under wrongful circumstances, which eventually forced him to file this Unum claim denial lawsuit. Plaintiff Dr. Ian L. worked as a licensed dentist and root canal specialist for years. He alleges he was supposed to receive Unum disability benefits should he ever need them.
Ian had two disability insurance policies with the Provident Life & Accident division of Unum. He obtained the policies separately in 1983 and 1985, and has made sure to keep up the required payments to keep the disability insurance active. Ian says he has dutifully paid the premiums for his insurance policies for the past 25 years, and has met all other eligibility requirements beyond the loss of income.
Ian needed these Unum disability benefits in 2012 when he reportedly suffered a catastrophic medical disability that had left him totally disabled. Provident initially paid the total disability benefits through the end of July 2013, with Ian returning to part time work in June 2013.
As indicated in the Unum claim denial lawsuit, there was an overlap period between when Ian was receiving benefits for total disability and returning to part time work. This should not have been a problem, as the policies provided “back to full time work benefits.”
However, Ian believes this overlap may have induced the claim denial, as Unum has refused to pay any further benefits since July 2013. Both of these disability insurance policies are supposed to provide Unum disability benefits, in the case of either total or partial disability.
Overview of Unum Disability Benefits
According to the Unum claim denial lawsuit, these policies were supposed to provide Unum disability benefits if the disability caused the policyholder to lose their job and caused them to lose 20% of their monthly income.
Ian reportedly sustained these financial damages, as he could not properly conduct his occupational duties and has not been able to gain employment in a similar field.
When Ian filed for Unum disability benefits, he says he submitted financial documents that provided his loss of income and all relevant medical testimony that proved the severity of his condition.
At this point in time, Ian believes he is entitled to all missing Unum disability benefits payments since July 2013. He has exhausted all administrative remedies and so has been forced to resort to legal action to retrieve those benefits.
Ian says he has not been able to collect sustainable income, with his medical bills continuing to mount. Ian alleges his Unum disability benefits were wrongfully denied, and is seeking damages for all missing payments.
