Major airline Delta, along with the third party online chat provider, were hit with a class action lawsuit over an alleged data breach that exposed the personal information of customers in 2017.

Lead plaintiff Teresa McGarry claims in the Delta data breach class action lawsuit that she and other Delta customers were not notified of the hacking for six months after it occurred.

She says that she had to spend extra time and effort to protect her financial information from the 2017 data breach because she wasn’t warned until April 2018.

“Despite the hack occurring six months prior, Delta customers were not notified of the breach of their sensitive information until April 2018,” alleges the Delta class action lawsuit. “Their [personally identifiable information] was available to hackers for six months without their knowledge. Data thieves had use of customers’ PII during this time while Delta customers were totally unaware.”

The plaintiff says that sensitive personal and financial information of those who booked with or flew on Delta was compromised in the alleged data breach. McGarry claims Delta customers were completely unaware of the breach for a period of months.

The airline informed its customers that their personally identifiable information had been exposed while they were using an online chat website, according to the Delta data breach class action lawsuit. Delta uses a third party to manage the site, also a defendant in the case.

According to the Delta class action lawsuit, the third party running the online chat room knew of the data breach for six months before it disclosed it to Delta. Delta allegedly learned of the breach on March 28, 2018 and sent affected customers notification that their personal information had been compromised in April. The notification informed affected consumers that the breach started in September and had resolved in October 2017.

The Delta data breach class action lawsuit argues that the airline and online chat provider should have protected consumer information better, especially in light of recent major data breaches at large companies.

However, the data protections put in place by the airline and online chat company were inadequate, alleges the Delta data breach class action lawsuit, amounting to negligence and violating consumer protection laws.

The plaintiff seeks to represent a nationwide Class of consumers who were affected by the breach, including those who booked with Delta or flew with the airline during the alleged data breach.

McGarry is seeking damages on behalf of herself and the proposed Class in the Delta data breach class action lawsuit.

The Delta customers are represented by Cale Howard Conley and Ranse M. Partin of Conley Griggs Partin LLP, Gregory M. Nespole of Wolf Haldenstein Adler Freeman & Herz, Denis F. Sheils and Barbara L. Gibson of Kohn Swift & Graf PC.

The Delta Data Breach Class Action Lawsuit is McGarry v. Delta Air Lines Inc., et al., Case No. 1:18-­cv­-02794, in the U.S. District Court for the Northern District of Georgia.

    I travel on Delta on August 30th 2018 I received an email three before my trip stated I two free loguages when I got to the airport the charger for both loguages although I show the email I still had to pay for both. That is deceptive.

    I received a letter from Delta Airlines in April of 2018. They told me that my charge card information could have been hacked as I paid for an airline ticket during that 2 week period. Please add me to the list.
