De Beers Diamond Class Action Lawsuit Settlement Approved

The De Beers diamond class action lawsuit has been hotly contested and delayed by challenges, appeals and extensive litigation but it has finally been approved. We received word about this, not from the attorneys working the case, but from Top Class Actions viewer Mary S. who noticed the change on the Settlement Administrator’s website. The De Beers diamond settlement is one that we’ve reported on extensively and was one of the original class actions that I listed when I started TCA. A little background on the De Beers Diamond Settlement. This is a HUGE class action lawsuit which has hundreds of millions of dollars reserved for claimants and affects multiple class action lawsuits. The class action lawsuits alleged that De Beers and its affiliated companies violated antitrust laws by monopolizing the diamond supply and controlling the price of diamonds. This control allegedly allowed De Beers to control the price of diamond jewelry. If you control the supply, you control, or have a direct impact, on everything beyond it. Both consumers who purchased loose diamonds or jewelry and jewelry store owners are affected by the alleged DeBeers monopoly and are allowed to submit claims. If you purchased diamonds, diamond jewelry, or other products containing diamonds you were able to submit a claim.
Please note that I said you were able to submit a claim. The deadline to file claims ended on May 19, 2008. If you didn’t submit a claim by that date your claim may be denied. If you did submit a claim by that date we hope that you will be paid once payments start going out. We do no know when that will happen or how much they will be. At this time we have not received any word from the Settlement Administrator who is processing the claims.
How much are consumers expecting? This class covers most consumers who purchased diamonds or diamond jewelry. As you’ll see, the claim could be significant:

Claims could be reduced depending on the number of claimants as well as how much each person claimed. I’m waiting to hear back from some of the attorneys who worked these cases.     Does anyone know the court (or name of the judge) that is overseeing the process? It would be the court in which the original decision was made (not the Appeals Court or the SC)?

    I would think that if they received dozens of email complaints (enough to clog their email account) that there has been no updates or issuance of checks, that the court would demand that the attorneys do a better job. The attorneys can ignore us, but they ignore the courts at their peril.

    If someone could post that info, I will gladly launch a complaint.

    Mary, if no settlement checks are cut forthwith, then after any potential small claims action is filed, the Defendants will need to respond to the lawsuit. And if they do not respond to the lawsuit, the court will rule in favor of the Small Claims Plaintiff with a Default Judgment. Then we get interest at the state statutory rate for any unpaid judgment balance thereafter.

    Beverly, I could not agree more! Except how do you get any information from anyone! I’ve called and get the same old message that everyone else gets, I’ve emailed the settlement people and get the same old standard message, in a few months, blah, blah, blah………. It’s getting to the point of driving to Minnesota and showing up at their offices!!

    Since the U.S. Supreme Court denied the final petition for this action on May 21, 2012, it has now been more than six months that damages have been due to claimants. We all know that if an individual owes money to a creditor, such as a bank for a credit card balance, and if that person makes NO effort to make any payment or make payment arrangement within six months, the creditor could arguably pursue a legal remedy, including a small claims action for the amount owed. I will be patient for approx one more week, but then I request court jurisdiction information since I am considering all of my own legal remedies, including small claims. It is time for the Defendants to cut the checks and send them to ALL claimants.

    It seems that none of us consumers have gotten paid yet. This has been a very long ordeal, and the time element alone is on the side of those writing the checks. Think of the number of people who have either passed away, moved, given up the fight, or had their lives impacted in some particular way that would hinder their receipt of these funds. I’m thinking that given the fact there has been some movement on this and we’re still sitting on our hands, maybe the media would find this ordeal interesting enough to probe, pick and dig into to find out what the delay is with the consumer $$$.

    Has ANYONE received their check yet???? The last update was August 31st!! I have emailed 2x and haven’t received any response! Says dealers were paid…..how about us consumers??? In this economy we are in, I’m sure I am not alone in saying a check would really be helpful!!!

    I email them last week and I received an email saying veiw the website sight for up date, no checks have been issued.
