Cricket Wireless class action lawsuit On June 3, 2015, a proposed class action lawsuit was filed in California federal court against Cricket Wireless LLC and its parent company AT&T Inc. with claims that the companies falsely advertised that they could provide unlimited 4G/LTE services to customers, when actual coverage was rare.

Lead plaintiff Flor Barraza hopes to represent unlimited 4G/LTE Class Members who, like her, relied on Cricket and AT&T to accurately represent their product and services but allege they were intentionally deceived.

The Cricket class action lawsuit claims that since 2012 the wireless cell phone company offered a 4G/LTE plan for a higher rate than their basic plan. However in order to use the 4G service, customers had to purchase a 4G/LTE capable phone which ranged in price from $399-$599. Barraza claims that despite Cricket advertisements throughout the state of California that they provided unlimited 4G/LTE coverage, actual coverage was limited to certain regions and nonexistent in some cities.

4G/LTE services are desirable for many customers as it gives the ability to download music, videos, media content with great speed. 4G/LTE plans also have practical functions like map features and GPS directions. These are just some of the services Barraza thought she was purchasing but claims that neither she or the proposed Class Members could have known that Cricket’s advertisement of unlimited 4G/LTE coverage was false.

The unlimited 4G/LTE class action lawsuit alleges that had Barraza been informed of the actual coverage Cricket provided she wouldn’t have paid for the higher costing 4G plan or purchased the 4G/LTE capable phone from the wireless phone company.

The Cricket class action was filed in a state court in San Francisco on April 27 but moved to a federal court this week. If approved, the unlimited 4G/LTE class action lawsuit would be open to Class Members in California who purchased a 4G/LTE capable phone or 4G/LTE service coverage from Cricket any time between May 1, 2012 to the present.

Barraza is seeking other potential unlimited 4G/LTE Class Members who were unaware that Cricket did not have the capability of providing any 4G/LTE services yet sold plans and phones to customers regardless. At least 1,000 Class Members are expected to be eligible to join the Cricket Wireless class action lawsuit.

The unlimited 4G/LTE class action lawsuit asks Cricket to cease its false advertising practices. Barraza has accused the wireless phone company of violating the California Legal Remedy Act, negligent misrepresentation and unconscionable conduct.

    I have been paying Cricket wireless 60 dollars a month for the 4glte unlimited plan and coverage is poor in my neighborhood of panama City fl, plus in the fourth week of every month cricket slows my poor data speed to a crawl! Cricket is guilty of bait and switch and false advertising. At&t thinks that they can scam consumers!

    I too have had this issue. I have been with cricket for 4 years and have always had the top unlimited (called extra now) to include unlimited 4g/lte with no data cap, and was never told that not all of their phones were compatible, however, I have purchased iPhones from them for the past 3 years, and yet my service and speed has progressively slowed more and more to where it is now always at a 3g-like speed. No one can help or fix the problem, and I am simply told that the network is “ temporarily congested”. There is nothing temporary about it. There is no way they can legally charge more for a service, they aren’t providing, even to qualifying phones. Not to mention that they are selling refurbished phones as new ones and at new prices. I had to find that out the hard way, and they won’t even acknowledge any wrongdoing let alone make things right. Please add me to this action, and there needs to be one filed for selling and see products as new ones if there isn’t one already.

      I forgot to also add that they have accessed my private’s pin # and Used it with out me being present to Add someone onto my plan. I called and went into stores multiple times and had multiple people make notes on my account that nobody was to have access to my account and if for some reason somebody called in and had my pin number that they would need to also ask all of the security questions. I had to change my pin number as well as all of my security questions and not a month after doing so somebody was able to call Cs without being asked or even knowing my new PIN number, or any of my security questions bc whomever originally accessed my old pin to add this person on my acct, meant that they had just as much access to my acct and billing info as myself. I ultimately had to get an entirely new bank card and separate myself from my own acct, that I had had since I switched to cricket 4 years ago. And now my service and speeds have slowed to 3g at best, and have been sold used phones (with issues) as new ones for new prices.

    I also had problems with it. First not working, then resetting, then i could not get certain people’s messages then sometimes people would not get mine.

      Cricket has sold me a couple of bad phones and they charged me more than the contract. I signed up for a $35 plan they are charging me $70 a month and they tell me they can’t change it back unless I pay the $70 and $10 extra to restore my service

    I’ve had so many problems with cricket ,and this lawsuit doesnt say you’ll be given your money back,the only choices are to stay with cricket and continue to use their service…??? Who would do that with the amount of un resolved problems I’ve had?
