Cricket Wireless class action lawsuit On June 3, 2015, a proposed class action lawsuit was filed in California federal court against Cricket Wireless LLC and its parent company AT&T Inc. with claims that the companies falsely advertised that they could provide unlimited 4G/LTE services to customers, when actual coverage was rare.

Lead plaintiff Flor Barraza hopes to represent unlimited 4G/LTE Class Members who, like her, relied on Cricket and AT&T to accurately represent their product and services but allege they were intentionally deceived.

The Cricket class action lawsuit claims that since 2012 the wireless cell phone company offered a 4G/LTE plan for a higher rate than their basic plan. However in order to use the 4G service, customers had to purchase a 4G/LTE capable phone which ranged in price from $399-$599. Barraza claims that despite Cricket advertisements throughout the state of California that they provided unlimited 4G/LTE coverage, actual coverage was limited to certain regions and nonexistent in some cities.

4G/LTE services are desirable for many customers as it gives the ability to download music, videos, media content with great speed. 4G/LTE plans also have practical functions like map features and GPS directions. These are just some of the services Barraza thought she was purchasing but claims that neither she or the proposed Class Members could have known that Cricket’s advertisement of unlimited 4G/LTE coverage was false.

The unlimited 4G/LTE class action lawsuit alleges that had Barraza been informed of the actual coverage Cricket provided she wouldn’t have paid for the higher costing 4G plan or purchased the 4G/LTE capable phone from the wireless phone company.

The Cricket class action was filed in a state court in San Francisco on April 27 but moved to a federal court this week. If approved, the unlimited 4G/LTE class action lawsuit would be open to Class Members in California who purchased a 4G/LTE capable phone or 4G/LTE service coverage from Cricket any time between May 1, 2012 to the present.

Barraza is seeking other potential unlimited 4G/LTE Class Members who were unaware that Cricket did not have the capability of providing any 4G/LTE services yet sold plans and phones to customers regardless. At least 1,000 Class Members are expected to be eligible to join the Cricket Wireless class action lawsuit.

The unlimited 4G/LTE class action lawsuit asks Cricket to cease its false advertising practices. Barraza has accused the wireless phone company of violating the California Legal Remedy Act, negligent misrepresentation and unconscionable conduct.

    I used to use cricket until boost movile had better phone plans, coverage, better phones that are lte that dont cost that much for the phone.

    Around 2014 the phones have changed on how the.sim cards work due to simm cards are not compatible with older phone where there website said it did work with older phones (cdma). That was misleading to me i used to be with them in arizona near 2006 when 1st staeted with cricket.

    I found out when I didn’t pay my bill that cricket blocked my phone completely. I had no internet service even in my house. I couldn’t open any of my apps. Since when is a phone company allowed to block you from using apps in which they have no rights to. How can cricket block me from using my Facebook, Instagram and even Pintrest.

    I had the same problem. I was told I had to get a new phone since they were making switch over to att and 4g. I did a couple of months before they switched then I started having problems. I told the lady at cricket store when i went back in, she told me that it wasn’t compatible. I told her that this was the whole reason I purchased a new phone number. If I knew it was gonna to be like this I would have kept my old phone. The new one I purchased even said 4g LTE on back of phone, which I pointed out. So I got another, I had it two months then I couldn’t get service. I went in and was told my phone wasn’t working. I needed a new one. Each time, I did this it charged me for the month. I ended up being ahead in payments that could not be refunded so I kept the service until I was paid up then I cancelled account and went with boost mobile. I had been a loyal customer with cricket and I loved their service. When att got their hands in cricket, everything went to hell. I will never use att anything. I live in ohio

      Horrible phone service and all calls go to Philippines…
      I ask to speak to someone that speaks my language and refused my rights to talk to me…
      I don’t want to apply to different phone service because I don’t want another credit check,;as I’m trying to get my fico scores up.
      I’m a widow and want to apply for a home loan as soon as I get my score up to par…

      We here in Texas was told the same thing that our existing phones would shutdown and or the service would not work well in April, I went in April only to find out I not only had to switch out my phone and pay more money, but I had to cease my phone, OMG this is crazy now. I received a postcard Saturday notifying me of a class action lawsuit, but it’s saying if settled I will receive 1GB or something of their service, WAAAAT are you serious!!! I don’t have cricket anymore because of their poor and high priced service, so am I really gonna benefit from this????

    Have Had Cricket WIRELESS since 2004 or 2005 maybe earlier they have as of late defrauded me and my domestic partner out of hundreds if not thousands of dollars while running billing and equipment purchase scams. not to mention privacy issues..(once the cs rep eavesdropped on my phone and made reference to a conversation we had after we had hung up the phone) .If I had access to my previous account records with them they speak volumes. this last time they lost connection on phone just as i had finished paying my bill . lead me to believe service is back on ..by the time I was finished they had charged me 3 months bill, when i tried to access my acct. to view payments made my cricket account was unavailable at this time. and so on. I asked them to creditee my acct. as all of a sudden my phone had a problem and needed to be,” replaced” .so i asked them to discontinue my service as they had charged me for 3 months of service on a pre paid plan…. their answer…. no reunds. i would have to buy a new phone or pay for 3 months service I couldnt use, possibly on 2 lines 700 to 1000 dollars. this is all besides their 4g lte “UNLIMITED” DATA. scam
    I am in ARIZONA . have had multiple accounts with cricket for 10 to 12 years . does any of this” class action” apply here if not might want to start one here.

      Did they charge the 3 months to a credit card? If so contact the credit card company to commence a charge-back which will result in the credit card company reveresing the charge. If a debit card or bank account was charged contact them to file a dispute to cause the bank to arrange to reverse the charges.

    I supposedly have an unlimited data plan 4G LTE in Pittsburgh PA. Is Pennsylvania included into the class action suit. My phone is currently not working due to “throttling”, I should not have any issues with an actual unlimited plan.
