Tractor spraying cropsIn June 2018, pharmaceutical giant Bayer purchased Monsanto for $63 billion while it was still facing thousands of Monsanto Roundup lawsuits. Now, Bayer has to face those claims, and recent court rulings on major glyphosate cases indicate that the company may face substantial or even devastating payouts.

Roundup, a popular weedkiller manufactured by Monsanto with the active ingredient glyphosate, has been linked with serious risks, including cancer. The International Agency for Research on Cancer (IARC) declared Roundup a probable carcinogen back in March 2015.

CNN reports that, in the last nine months alone, juries in two separate lawsuits have determined that the weedkiller Roundup was a major factor in causing cancer. With thousands more such lawsuits pending at the federal or state level, and more likely on the way after these recent results, Bayer may find that its acquisition of Monsanto—and the Monsanto Roundup lawsuits—is more than they bargained for. In August 2018, a California jury awarded a man $289 million (later reduced to $78 million) in punitive and compensatory damages for his glyphosate cancer .

Bayer maintains that the glyphosate in Monsanto Roundup is safe, and the company intends to keep fighting this litigation.

Bayer Shares Take a Nosedive

After the merger with Monsanto, Bayer’s shares began to plummet dramatically. The Supervisory Board also released a statement in support of the Bayer Board of Management in an effort to restore shareholder confidence.

On top of loss of shareholder confidence, Bayer still faces around 13,400 glyphosate lawsuits. Damien Conover, an analyst for Morningstar who covers Bayer, told CNN that glyphosate litigation could wind up pay $2.2 billion in glyphosate litigation costs—and in a worst-case scenario for the company, even above $14.6 billion.

While the United States is still fiercely debating the health risks of glyphosate, other countries are taking steps to reduce the risk of glyphosate exposure. In Sri Lanka, glyphosate is banned because of a connection with human kidney disease, and Brazil is considering a ban. New regulations have been placed on glyphosate products in the Netherlands and New Mexico.
