dynamic-dog-bone-imageA grieving pet owner whose basset hound died after consuming Dynamic Pet Products Real Ham Bone for Dogs is suing the manufacturers of the product, saying it is falsely marketed as a safe chew toy for dogs because it is prone to splintering into shards that slice through dogs’ digestive systems.

Plaintiff Khristie Reed alleges in the class action lawsuit, filed May 2, that she and potentially thousands of other dog owners (and potential Class Members) had to watch their dogs suffer from injuries and sometimes die after ingesting shard’s from the allegedly defective “Real Ham Bone for Dogs” manufactured by defendants Dynamic Pet Products and Frick’s Meat Products Inc.

According to Reed’s dog chew toy class action lawsuit:

“The Real Ham Bone For Dogs is not appropriate for dogs and is not safe for its intended purpose, despite Defendants’ contrary representations. When chewed, Real Ham Bones For Dogs are prone to splintering into shards, which then slice through dogs’ digestive systems. Thousands of dogs have suffered a terrible array of illnesses, including stomach, intestinal and rectal bleeding, vomiting, diarrhea, constipation and seizures, and have died gruesome, bloody deaths as a result of chewing Defendants’ Real Ham Bone For Dogs.”

Since Dynamic began marketing their dog chew toy products in 2001, thousands of consumers across the nation have bought Dynamic dog chew toys from retail locations like Wal-Mart, Sam’s Club, and Dollar General. Reed alleges the parent company created Dynamic as a way to sell the waste of its meat products by using it in their dog bone chew toys.

However, the FDA issued a 2010 statement, which warned dog owners that splinters from dog bones could result in severe pet injury and/or death.

Following this FDA warning, Missouri’s Better Business Bureau informed Dynamic and its parent company the dangers associated with their dog chew toy products. However, despite the FDA and MBBB warnings, Dynamic continued to market their dog bone chew toy products and neglected to add a safety warning, the Dynamic class action lawsuit claims.

The plaintiff further alleges that Dynamic was aware of the dog bone chew toy dangers in 2006, at which time numerous consumers complained to Dynamic that their pets were injured or died as a result of their dog chew toy products. Reed claims Dynamic and its parent company Frick violated Consumer Legal Remedies Act by continuing to market their dog bone chew toy products and misrepresents their pet products as safe.

According to the Dynamic dog chew toy class action lawsuit, Reed is seeking actual and punitive damages, as well as attorney’s fees. The class action lawsuit also seeks to establish an injunction to prevent Dynamic and Frick from continuing their unlawful business practices that harm consumers and their pets.

The Dynamic Dog Chew Toy Class Action Lawsuit is Khristie Reed v. Dynamic Pet Products and Frick’s Meat Products Inc., Case No. 3:15-cv-00987 in the U.S. District Court for the Southern District of California.

UPDATE: On Feb. 9, 2016, Dynamic Pet Products asked a California federal judge to dismiss the “Real Ham Bone” class action lawsuit, listing seven reasons why.

UPDATE 2: On July 21, 2016: the judge denied a motion made by Dynamic Pet Products to dismiss the chew toy class action lawsuit.

    How do I get in on this suit? I bought these for my 3 dogs. All 3 had injury to an extent and I feel as if I want in on this too. None of my dogs died but my Mac Had a sliver come thru his jaw ( the skin) and my Buttercup had a piece stuck in her lip. Poor little Abby had her gums poked until they bled. Please can anyone tell me how to sign up for this? Thank you in advance.

    Im so upset about this. I have 2 emotional support dogs. N my poor baby was poopin blood and I couldnt figure out why until I saw a piece of this bone in it. He is fine now but I dont appreciate these ppl hurting our babies (dog) just to make a buck. How low

    My dog choked and thankfully I was able to get my fingers in and turn bone sideways and pull out. She had breathing problems for about two weeks. I’d love to be contacted for this class suit. I never buy anything from Walmart (where I bought those thinking they weren’t chemically treated crap) anyhow now she is on grain free food, fresh food roll to put meds in since pill pockets have corn in them and new chicken jerkey rated for human consumption.

    I pur hased two olde english bulldog pups for our 18th weddi g anniversary.Sluggo was my male he was 15 weeks old.Vety healthy well my husband n I did not know bout any te all n bought two of these bones and o. oct 17th my anniversary i noticed my sluggo was struggling n fell over choking! I rusted to hom n attempted to chear his airway.Then he strated bleeding horribly from the mouth as im still trying .My 11 yr old twons watched my attempts to sabe my lil sluggo. He passed away on my armsWe are devestated.

    My story is so similar to the many heartbreaking stories I have read. I thought my experience was an isolated bad case, but after seeing all the stories that come out on TV and now investigating I now realize the magnitude of how many dogs have been affected and died. Astounding!! I have three medium-sized, healthy & young dogs for whom my husband purchased 3 of the Dynamic Ham bones as a special treat from Walmart on May 16th, 2015. I make all my jerky and treats home made and am very particular about what they eat but for some reason I gave in, and now totally regret allowing them to have these bones. My dogs all chewed on them that evening and the following morning the diarrhea and vomitting was endless by all three of them. I really thought it was just a case of not tolerating the bones and it would be better as they day would go on. By early evening one of my Aussie dogs was deteriorating quite rapidly, finding her almost lifeless we rushed her to the emergency vet that evening. The vet told us the only thing that saved her in that moment was a last rush of her adrenaline kicking in as we picked her up and rushed in the car to the emergency care clinic. She hung on by a thread and underwent emergency intestinal surgery that night. She had a large blockage from the bone along with thousands of small pieces of shards throughout her intestines that had to be flushed out over and over. She made it through the surgery but now had acute pancreatitis and hemorrhagic gastroenteritis from the marrow and shards~most likely always a deadly combination we were told. We sadly waited over the next 24hrs as she was given acute intensive care, and being young and otherwise healthy, she started to miraculously improve. It was a slow and painful recovery in the days ahead from the ~50 or so staples she had along her abdomen. She did luckily recover. Our vet bill was $6,000 for those 3 days alone. Our two other dogs continued to have symptoms for several days following as well, but feel blessed they did not have to go through what our other pup did. I recently this summer have seen these bones still for sale in the clearance racks at Walmart and also Menards. How frightening and shameful for them to still be out there after all these complaints, deaths and distraught to all these pets and families? Yes, I would definitely want to be part of the class action filing. Please let me know any further information or what I can do.

    PLEASE INCLUDE ME IN THE CLASS ACTION LAWSUIT…I have been dealing with the Dynamic Pet Corp in which WalMart, whom I purchased the product from April 2015, and STILL had them on the selves in the Pet Isle as of a week ago…their Corporate Claims, directed me to the manufacturer…Dynamic Pet Corp. At the time they agreed to reimburse me for ALL MY COSTS INCURRED for my dog, who suffered and bleed in horrible pain for OVER a week…with 2 visits to the vet and all the costs that took…not to mention my 24/7 care for him for over a week, bool EVERYWHERE…in my home, on the patio, on the sidewalk and street…WalMart has FAILED to pull the product.     AS A PET STORE OWNER, selling dog treats etc…We never carried these cheap treats from China or even Canada or Brazil. Our customers complained about the costs of our dog treats and properly sourced dog bones and chews….but we never had a complaint nor a poor doggie suffer and die from eating a dog treat. all of you cheapskates wanting cheap treats, that is your reward for buying cheap and buying crap from China. it is sad, the crap they get dogs to eat is horrible. especially from Sargeants, Purina, Etc etc I see all you dollar store cheapasses buying Sargeants Barkery dog treats, if you only knew the sourcing of that food n crap that you give to your dogs….stop buying crap for your dogs n cats. and do some nutritional research for things to feed your pet, and definitely not sugar laden Kibbles n Bits dog food….sugar for your dog…mmmmmmmm. not good. buyer beware.
