Clarins-Paris-body-Fit-Anti-Cellulite-Contouring-ExpertClarins USA Inc. was hit with a class action lawsuit alleging that its Paris Body Fit Anti-Cellulite Contouring Expert cream doesn’t work.

Plaintiff Tiffiany Blackwell alleges in her class action lawsuit that she used the $70 cream in an attempt to avoid surgery to remove cellulite. However, Blackwell says the product did not work and she learned that surgery is the only way to deal with cellulite.

The plaintiff claims that she was approached by a Clarins representative while shopping. The Clarins representative allegedly told the plaintiff that many people have noticed great results after using the cream. The plaintiff said that these representations convinced her to buy the cream on two occasions for $70 each time.

“Defendant’s representations are false and misleading because surgery is the only way to reshape, firm, and lift skin that is sagging or loose,” Blackwell alleges. “There are no ingredients in Defendant’s Product that are capable of producing a lasting effect that counters the myriad factors that cause skin sagging, loosening, and cellulite.”

The plaintiff says the company’s marketing of Clarins Paris Body Fit Anti-Cellulite Contouring Expert induced her to pay a premium price for the cream, but if she had known the cream was worthless for the purpose advertised she would not have purchased it.

“By purchasing the falsely advertised product, Plaintiff suffered injury-in-fact and lost money,” alleges the Clarins class action lawsuit.

According to the plaintiff, Clarins advertises the cream as including Quince Leaf extract, which the company claims helps reduce the look of cellulite with targeted refining and reshaping actions. Further, Clarins’ website allegedly claims the leaf extract has the “unique ability to visibly smooth, firm and lift.”

“Skin loosens and sags overtime due to gravity, muscle loss, hormone shifts, and other factors. The only way to firm, lift or reshape loose and/or sagging skin is to have surgery,” alleges the plaintiff in her class action. “The Product has no ingredients that are capable of changing the shape of, or firming and lifting, a person’s skin.”

Blackwell seeks to represent a multi-state Class of individuals who purchased Clarins Paris Body Fit Anti-Cellulite Contouring Expert cream for personal use. The states include California, Colorado, Florida, Illinois, Indiana, Massachusetts, Michigan, Minnesota, Missouri, Nebraska, New Jersey, New York, Ohio, Oregon, and Washington.

The plaintiff is seeking damages and disgorgement of profit from the sale of the cream as well as an order stopping Clarins from its allegedly fraudulent and deceptive marketing practices.
