chrysler_logo3FCA US LLC has been hit with a class action lawsuit that alleges an engine defect in certain Chrysler Pacifica vehicles causes them to shut off or stall without warning.

The alleged Chrysler Pacifica stalling defect allegedly affects all 2017-2018 Chrysler Pacifica vehicles equipped with a 3.6-liter V6 engine and a 9-Speed 948TE FWD automatic transmission.

According to the FCA class action lawsuit, more than 50 individuals have reported to the National Highway Traffic Safety Administration that their vehicles lost power without warning.

Individuals reported that they had experienced the Chrysler Pacifica stalling defect at varying speeds, including while idling, traveling 40 miles per hour on municipal roads, and while traveling at highway speeds.

“The Stalling Defect prevents the driver from operating the vehicle as intended, which results in a range of unsafe conditions, including the inability to change speed or steer, often while in traffic and at high rates of speed,” the Chrysler Pacifica class action lawsuit states. “The hazards presented – to the driver and others – by the driver’s loss of control are unreasonable.”

Plaintiffs Ryan and Sarah Wildin claim they purchased a new 2017 Chrysler Pacifica in September 2016, believing the vehicle would be safe and reliable. However, after purchasing the vehicle, they claim they experienced the stalling defect on multiple occasions.

According to the Chrysler Pacifica class action lawsuit, the Wildins’ vehicle stalled while they were driving on the highway and they were nearly rear-ended by another vehicle. They subsequently took the vehicle in to an authorized FCA repair facility for repairs.

The Wildins’ Chrysler Pacifica vehicle continues to exhibit the alleged stalling defect and they claim that FCA has been unable or unwilling to repair it. According to the FCA class action lawsuit, they would not have purchased the Chrysler Pacifica if they had known it contained a dangerous stalling defect.

Based on consumer complaints, FCA is aware of the Chrysler Pacifica stalling defect, the Wildins claim in the stalling defect class action lawsuit.

The Wildins filed the Chrysler Pacifica class action lawsuit on behalf of themselves and a proposed Class of individuals who purchased or leased any 2016 or 2017 Chrysler Pacifica vehicle from an authorized FCA dealer. They also seek to represent subclasses of consumers who reside in California, who purchased or leased their vehicles in California, and/or who are considered “consumers” under the California Consumers Legal Remedies Act.

The Chrysler Pacifica class action lawsuit asserts claims for violations of California’s Consumers Legal Remedies Act, Unfair Competition Law, breach of implied warranty pursuant to the Song-Beverly Consumer Warranty Act, breach of implied warranty pursuant to the Magnuson-Moss Warranty Act and unjust enrichment.

The plaintiffs are seeking restitution; attorneys’ fees and costs; exemplary and statutory damages; declaratory relief; and other damages.

The Wildins are represented by Jordan L. Lurie, Tarek H. Zohdy, Cody R. Padgett, and Karen L. Wallace of Capstone Law APC.

UPDATE: On May 11, 2018, drivers fought back against Fiat Chrysler’s attempt to toss out a class action lawsuit claiming Pacifica vehicles are defective, after extensive back and forth with the company over the last few months.

    I have a 2008 Pacifica Limited 4.0L & same problem happened numerous times.
    1st time: car shut off 65 mph on Hwy. Engine light came on, dealer ran & ID’d engine code & said they’d sv but ‘Somehow’ code cleared & dealer said nothing wrong now?! Charged diagnostic fee (no repair).
    2nd time: 40 mph, engine shut off, couldn’t steer, car went off rd & just missed hitting tree. Pd diag fee but again, dealer said ‘nothing wrong’.
    3rd time (wks later): 70mph on hwy, sudden drastic lost of power, almost rear ended by 18 wheeler who swerved into left lane & almost hit another car. Would have been serious multi vehicle accident. Pulled off rd & towed to dealer. Had car for a month. Said motor mounts needed replcmt but no cause found for loss of power. Cost thous’s in repair (mine was outside recall window for motor mounts).
    CHRYSLER CHQ HAS KNOWN ABOUT THESE PROBLEMS FOR YEARS & FAILS TO ADDRESS THEM. I opened numerous cases; battery replaced 7 times (unable to ID cause), motor mounts replaced 2 times in 3 yrs, (failed parts), differential replaced 3 times (failed parts), Evap code keeps intermittently occurring (no cause ID’d).

    Have 2011 chrystler town and country purchased new. Converted to braunability with hand controls and ez lock system to allow me to drive from my wheelchair. This has happened to me several times. I am locked in and can’t get out unless someone manually releases me. Dealership can’t find the problem however June 2017 they replaced a module. Began having same problem a year later. Very scary. I am an amputee and have to have van towed. Power chair has to stay in van and I have to find some way to get me home as I can’t walk. Someone has to get annual chair and a vehicle that I can get in. All the light start flashing and van immediately stops. I am terrified that it will catch on fire and I am stuck as I am usually driving by myself. HELP!

    I have the same problem. It is very scary driving with my two kids. They keep telling me to take the car back to the dearlership and they never fix the problem.

    I also have had the same issues with my 2017 Chrysler Pacifica touring l plus. I bought this van brand new from the dealership. It would randomly shut down at the worst times. I almost got hit by a semi because of it. Loss of power of engine and gear shifted to neutral all the time. Took it in several times and they said everything was normal,but they updated the computer. Drove it off, a day later same thing. I tried to take Chrysler to court in Wisconsin for the lemon law, and my attorney dropped my case and sided with Chrysler about this van. I finally had enough and took a massive loss on the car and just sold it. I was actually affraid to drive the van.

    5/10/18 purchased a “new Pacifica” had about 4.500 dealer miles. Had the same failures described above several times, once pulling out of a parking lot and it died, several times driving at highway speeds it cut off and after coasting seemed to restart by its self. On a trip it decided to not operate the headlights that lasted almost all of the day. Later they came on. The radio lowered to barely audible and could not be turned up, had several warnings on the dash about approaching something didn’t have time to read entire message, Problem straitened up that night and started acting up later the next day on way home. Worked fine for two weeks then the engine dies. After stopping I was able to restart it. Dealer unable to find any problems and they drove it “200” miles without any problems. Their advice is to just drive it until it repeats and get it towed in. Corporate unable to assist without knowing what the problem is. Certainly not comfortable with driving it. I loved my 06 Grand Caravan, along with my 10 other Mopar products. This is the first one that has let me down before 50,001 miles.

    I have a 2008 Pt Cruiser stalls while driving almost had an accidents due to this problem. Sometimes I can go for 3 weeks and happens again I had a mechanic look at it can’t find problem! somebody please help!! My son and I could end up dead due to this problem.

    I too am suffering from my car stalling while driving various speeds. I drive a 2013 Chrysler 200. My car has stalled more than 15 times since May 14 2017. I’ve only taken my car to Chrysler dealerships to be serviced and not one of the 5 dealerships can tell me what’s wrong with it. FCA was no help either. I’ve had the fuel pump replaced twice something called a PCM and the crankshaft sensor. And none of those seem to have fixed the problem on my car. I live in Michigan where the weather can get below zero at times. I’ve had to sit in my car in the middle of traffic in tears waiting on a tow truck or someone to come i my rescue. It’s frustrating and sad that I’m barely driving a car that I’m paying for.

    I had the same problem with my 2014, I spent hundreds of dollars trying to repair the stall. Received no help when I reported to Chrysler.

    It’s not just the Pacifica’s!! There are other models that due that to say the very least, plus some and hundreds of complaints on FCA website as well as many others. Some have been suffered severely due to accidents related to the exact same issue. I myself am enraged and confused as to why the 2008 Chrysler PT cruiser has not had ANY recalls!?! Not only does car stall for no reason, the electrical system is outta wack completely from horn/alarm system going off at any giving time; whether your driving or in your home asleep, including doors locking and unlocking on their own. Air-conditioning being ran along with radio seems to blow brake lights. First time my car stalled on me, my 4 yes old and I were on turpike going speeds of 65-70mph. We could’ve died. Had I not been taught to drive on a standard growing up I would of lost control and panicked it was raining hard semis flying by us busy busy freeway; thankfully I calmly threw it into nuetral restarted the engine before being ran into from behind or off the road; it happened 3 times in that 2hr drive that day. NO ONE HAS GIVEN MANY OF US ANY EXPLANATION, OR ACKNOWLEDGE ANY OF MY COMPLAINTS TO CHRYSTLER or FCA.
