Chase class action lawsuit overview:

  • Who: Plaintiff Alfredo Chaidez filed a class action lawsuit against Chase Bank.
  • Why: Chase allegedly uses software to “eavesdrop” on customers’ phone calls to the bank’s contact center in violation of California privacy law.
  • Where: The Chase class action lawsuit was filed in California federal court.

Chase Bank violates California customers’ privacy by “eavesdropping” on callers and recording their biometric voice prints without their express consent, a Chase class action lawsuit alleges.

Plaintiff Alfredo Chaidez alleges Chase has integrated a voice biometric security program called Gatekeeper, which is meant to detect and prevent banking fraud.

The Chase class action lawsuit says the bank uses Gatekeeper to monitor telephone calls to its customer center.

“In a matter of seconds, Gatekeeper authenticates customers without prompting them to enter passwords or PINs, recite specific phrases or statements, or match the pitch, timbre, or rhythm of prior recordings of their speech,” the Chase class action lawsuit says.

Instead, Gatekeeper allegedly analyzes other factors such as the caller’s environment and behavior to “passively authenticate” them when they speak with the contact center and does so without obtaining the caller’s consent.

Chaidez claims that Chase’s use of Gatekeeper violates numerous provisions of the California Invasion of Privacy Act.

Chase class action says Gatekeeper technology collects voice prints without consent

Gatekeeper technology allegedly analyzes callers’ voice signatures, including their speech patterns and language use. By collecting and considering their unique voiceprints, it purports to ascertain the truth of the caller’s statements.

“Voice prints” such as those collected by Gatekeeper essentially create an audible “fingerprint” that can identify an individual and reveal behavioral traits, the Chase class action lawsuit says.

These voice prints are collected without the callers’ knowledge or consent, Chaidez claims.

Chase also allegedly fails to notify callers in California that third parties are listening to, recording, and analyzing their confidential communications with Chase, according to Chaidez.

Chaidez says that he has called Chases’ contact center on several occasions and expected his conversation to be confidential. He did not realize that, by calling Chase’s contact center, his telephone would be tapped without his consent and in violation of California privacy law.

Chaidez filed the Chase class action lawsuit on behalf of himself and a proposed Class of California residents who had their voice prints or conversations recorded via Gatekeeper.

Chase has also come under fire for allegedly charging customers unfair overdraft fees on debit card purchases.

    I am another victim of Chase and a California resident at the time of this class action lawsuit’s claims. Chase sucks. They are criminals who steal from and spy on their own clients. The biggest risk to Chase’s reputation is Chase. Please add my name.

    Customer of Chase bank for over 25 years. Retired, moving overseas and put a request for a cash withdrawal. First at my local branch, was ignored with no call back and had to drive there twice in 10 days. All they did at the end: gave me a phone# of Santa Cruz branch – this # is unreachable. Drove there, talked to the manager and didn’t hear back for another week. Drove there again and had to ask for an Executive office #. Got a case number, was calling a person handling my case for 10 days, she never called me with any info. Escalated the case and finally, after dealing with Chase for 2.5 months, was told that I can pick up my cash in 3 visits. They gave me days and time when I should come to SC branch to collect. At the day the first withdrawal should be, this person from Executive office called me 3 hours prior to my visit to Chase and stated coldly: We are closing your account and you can come prior to Monday for a cashier check from them.
    In all this time I went through a total humiliation of begging to Please, let me to withdraw my money. Nervous break downs, had days when I felt I’m nearing a heart attack. An Elderly Abuse and humiliation – that’s the only how I can describe how Chase treats the customer with the highest credit score, diligent, truthful, with the large amount in the Chase account. Every day of those 2.5 months I had to answer over and over why I need a cash withdrawal. And the day before they scheduled for me to come in and take a first set of cash, they called and interrogated with so many questions. Made me feel as a criminal. On top of evrything else they put me through and didn’t release a penny to me from my own money. Chase just decided to close my account instead..after telling me that I can collect my money in 3 visits to the bank.

    Chase Bank is a sore subject with me for 4 months from December of 2021 to April of 2021 I was in a negative balance with my direct deposits adding up to 58 to 6300 a month they kept me and I was not able to use my card they it was all fraudulent they would not clear the fraud I still have not recovered any money from late fees or anything like that they took my stimulus check a 1400 they let me have a couple hundred of it and even the bank manager called the broad account and they gave me the credit for a little bit but then they took it back stating because they could not collect on the fraud that I could not have my money returned for 4 months with balances direct deposits of $6,300 a month I was not able to eat I had to borrow money they still have not tried to reach me or settle that I don’t know what to do
