A California federal judge on Friday approved a $19 million class action lawsuit settlement with Burger King Corp. over allegations its restaurants do not provide wheelchair access in violation of the Americans with Disabilities Act. Class Members of the Burger King settlement stand to receive over $8,200 each, according to the Class Counsel.

The Burger King wheelchair access settlement will resolve a 2011 class action lawsuit, titled Vallabhapurapu, et al v. Burger King Corporation, that alleges 86 Burger King restaurants in California have – or have had any time since October 2006 – barriers to customers who use wheelchairs or scooters. Examples of these types of barriers include: narrow “queue lines,” doors that are too narrow or difficult to open; inaccessible restrooms, seating and parking; inaccessible condiments, napkins and other items; and other wheelchair or scooter access problems.

Burger King denies any wrongdoing but has agreed to establish a $19 million class action lawsuit settlement to resolve the litigation, as well as to provide significant injunctive relief. The company has already removed most of the alleged access barriers at the restaurants involved and will be making additional improvements to access.

Class Members of the Burger King wheelchair access class action settlement include all customers who use a wheelchair or scooter for mobility and encountered access problems at one of the 86 California Burger King restaurants listed here and on the second page of the Settlement Notice.

Plaintiff attorneys estimate the average recovery per Class Member will be over $8,200, after deductions for attorney’s fees and costs.

The ONLY way to receive money from the Burger King ADA class action lawsuit settlement is to submit a Claim Form by November 15, 2012. You can obtain a Claim Form by visiting www.BurgerKingClassAction.net or by calling 1-888-569-9477. If you do not opt-in, you will not be eligible to receive any money from the settlement fund.

    When I called GCG, I simply wanted to know the timeline in which they are working to complete their processing of claims. They gave unclear answers to a simple question.

    What nerve!!!!! The settlement stated that I was already approved so that an indicator that the checks should not take long.. but seems that some are having issues with either getting a claim form or having their call answered… well good luck with that.

    I know everyone is wondering when checks will be distributed. The answer is We will get them when we get them. There is a process and calling them will not speed it up. My suggestion: Wait 90 days from November 15th, then start worring.

    Any word on when checks will be distributed to the class members? Ive contacted those crazy folks working at GGC and they always seem to transfer me to a voice mail stating that the people handling this are in a meeting. Well, Ive called all day for a few days in a row and you mean to tell me, they are still in a meeting. Something fishy is going on with these people.

    I thought closing deadline was 11/15 not the 19th….I agree of the rude behavior and extra questions they had just to get a claim form….

    GGC in Seattle, Washington answers this 888 number (888)569.9477. I asked for a claim form mailed to me three weeks before closing date, I never received. I called spoke to Alex who said will email it never got tha email. I called three days in row cause close date nov 19th. So! The last time I called the claim form showed up in my email that moment. I’m in a wheelchair I have a driver who drove me to post office. I got a reciept that postmark nov 19th. GGC in seattle gave me the run around trying to mak me miss closing date they even emailed other people claim forms, which I saved for future reference. Also others encountered the same thing.they wanted people to miss deadline. I have proof & recorded the lies they told Alex & Leo. So! I already contacted counsel & the contacted the others they did this to plus asking people do they know people what the hell! What does that have do with the class. Some people have MS they can’t do the computer &GGC asked who email it iisis.un.believable. if you need or don’t receive your check contact counsel right away

    the company in seattle washington was rude , I called for my claim form 11/6 and received it 11/13…2days before the deadline date… I did fill it out and get it mailed immediately so that It was posted marked by the due date

    GGC company in seattle washington handling the burger king classaction. I asked them to mail mea claim form a week before closing date I never got it. I asked them to email to me they ask me unethical questions like who email is this leo threw names at me that I. Didn’t know, it was ridicilious. I’ve. Already been violated and now there doing it again. I think the porper people should know of this.

    For all of those asking when the checks will be distributed: Please call the law firm handling the case and ask them because they are the only people with that information. Good luck to those who experienced some problems at BK.
