Buffalo Wild Wings SignBuffalo Wild Wings Inc. has been hit with a class action lawsuit alleging it deceives vegetarian customers about their dining options because the restaurant deceptively cooks vegetarian meals in beef tallow.

“A large and growing segment of our population are vegetarian,” plaintiff Alexa Borenkoff says in the Buffalo Wild Wings class action lawsuit. “BWW is deceiving these consumers because it does not list beef tallow as an ingredient, disclose using beef tallow on its menu, or reference using beef tallow. Vegetarians are choosing, consuming, and paying for items cooked in beef tallow they would not have purchased.”

According to the Buffalo Wild Wings class action lawsuit, five percent of the U.S. population is vegetarian. There are many reasons that consumers choose to be vegetarian, including better health, religious reasons and/or religious restrictions.

Borenkoff states in the class action lawsuit that she is a vegetarian and that she dined at two separate Buffalo Wild Wings locations in New York. During these visits, she ordered French fries and mozzarella sticks, which the restaurant did not disclose were cooked in beef tallow.

Buffalo Wild Wings uses beef tallow to fry all items in its restaurants but fails to disclose that it uses beef tallow as an ingredient, the class action lawsuit alleges. Borenkoff argues that the industry standard is to use non-beef cooking oil to fry items.

“Because BWW does not list beef tallow as an ingredient, disclose its use on the menu, or reference using beef tallow, vegetarians are purchasing items such as the garden crasher, Mediterranean salad, roasted garlic breaded mushrooms, cheese curds, corn tortilla chips and red salsa, potato wedges, French fries, ultimate cheese sampler, etc., that are cooked in beef tallow,” the Buffalo Wild Wings class action lawsuit states.

Borenkoff asserts that vegetarians would not purchase any of these menu items if the restaurant disclosed that they were cooked in beef tallow. She alleges that a reasonable vegetarian customer would be deceived by Buffalo Wild Wings’ material misrepresentations and omissions.

According to the BWW class action lawsuit, Borenkoff did not discover that the menu items she purchased and consumed contained beef tallow until after she made the purchase.

She asserts that many vegetarian consumers are unaware that Buffalo Wild Wings uses beef tallow in many of its menu items and that they will continue to purchase items that they would not otherwise purchase.

By filing the Buffalo Wild Wings class action lawsuit, Borenkoff seeks to represent herself and a Class of vegetarian Buffalo Wild Wings consumers who purchased items cooked in beef tallow.

The plaintiff asserts Buffalo Wild Wings violated New York law by using deceptive or misleading practices by failing to disclose that its fried foods were cooked in beef tallow. She also asserts a claim for unjust enrichment.

Borenkoff seeks compensatory damages, punitive damages, injunctive relief, attorneys’ fees and other costs deemed appropriate by the court.

UPDATE: On Jan. 19, 2018, a federal judge dismissed claims that Buffalo Wild Wings allegedly fails to notify customers that it fries non-meat food items in beef tallow.

    I used to take my sister every time she,came in from NYC. To find out it was fried in beef tallow is inexcusable.
    I can’t count how many times I paid for my sister’s meals there. She’s been a strict vegetarian for years. I’m at a loss for words here. Need to sign up

    I agree with plaintiff. I’m a long-time vegetarian, and we rely on restaurants to be honest and forthcoming about their food prep methods. There is a reasonable expectation that a menu item advertised as “vegetarian” will not be cooked in animal fat. Who uses lard anyway? That is a shortening from a bygone era. Even McDonald’s did away with it years ago. To the commenter @dumbfounded — not all vegetarians are health fanatics. Some are “ethical” vegetarians who don’t want to contribute to the slaughter of animals.

    If the menu stated these were vegetarian options or that they fry in 100% vegetable oil then it was misrepresented. As noted above, this is a fried chicken establishment – unless they claim to have a vegetable only fryer nothing that goes in will be completely animal free.

    Okay, this one is just plain ridiculous! It wouldn’t matter what kind of oil they used, if a “vegetarian” is truly concerned then why would they order deep fried food from a restaurant chain that deep fries mass amounts of chicken at a rapid pace. It could start as the purest vegetable oil on the market and after 100 lbs of chicken is fried I’m pretty sure it would be the same as using an animal fat oil for frying at that point. BWW isn’t trying to hide anything. They offer unhealthy fried foods, alcohol and a good time as advertised.

    I hope they have to pay enough for it to hurt.

    Regardless of the vegetarianism issue, people should be informed consumers. Hiding food ingredients is absolutely unacceptable. Period. Whether the issue is allergies, interactions with medicines, or any of the reasons in the suit, consumers have to be able to trust that all ingredients are listed.

    As to the suggestion that vegetarian foods are labeled as such, that is simply not true. The vast majority of vegetarian foods have no such label.

    PeopleSuCk, clearly you are a very classy person, but it is not at all sensible to assume that vegetables and other non-meat foods are cooked in beef. Do you cook all your vegetables in beef? McDonald’s got sued for the same thing 15 years ago and they lost, so BWW should know better.

    I would like an update to this. I am vegetarian, health and ethical reasons, and would be appalled that I was consuming beef tallow.

    No, it’s not. Any reasonable vegetarian with a lick of common sense who did not see a vegetarian symbol on the menu would ask or leave. Jesus Christ on a frickin’ popsicle stick people. WHAT IS WRONG WITH YOU?
