
Consumers who received a call from British Airways customer care numbers, and did not hear a call recording warning before the call, may have had their conversation recorded in violation of privacy laws.
Consumer advocates are looking into allegations that California consumers who received a call from a British Airways customer care number may be eligible for compensation. Although no specific allegations have been made, businesses under investigation include American Airlines, British Airways, Cannondale Bicycle Corporation, Czech Airlines, Dermalogica, Fisher & Paykel, Harman Audio, Hunter Boots, JBL Audio, Malaysia Airlines, Romano’s Macaroni Grill, and Tupperware.
Under the California constitution, privacy is considered an inalienable right and fiercely protected. The state has the strictest privacy laws in the country with several laws in place to protect from breaches of privacy. In 1967, in the face of growing technology, the state passed the California Invasion of Privacy Act which protects the state’s consumers from breaches of privacy through technological means.
Under the California Invasion of Privacy Act, businesses, such as British Airways customer care, are not permitted to record phone calls without the consent of all parties. California call recording law prohibits “maliciously and without the consent of all parties to the communication, [intercepting], [receiving], or [assisting] in intercepting or receiving a communication transmitted between cellular radiotelephones or between any cellular radiotelephone and a landline telephone”. Similar statues are in place between other telephone devices.
Consumers who did not receive a warning before a phone call from British Airways customer care or other businesses may have had their conversation recorded without their consent. Businesses are required to warn consumers that their calls may be recorded immediately at the beginning of the call. If consumers stay on the line following such a warning, it is legally considered consenting to the call recording.
Many companies faces with call recording lawsuits claim that the practice of recording calls is for training or customer service purposes. However, even if a phone call is recorded for non-nefarious purposes, recording a call without consent is illegal. Such arguments do not stand up in court and companies are often ordered to pay damages for violations of call recording laws.
Call recording laws indicate that companies may have to pay up to $5,000 per violation, or three times the amount of damages sustained. Instead of risking the high costs of legal actions, companies may choose to settle a lawsuit before trial.
