best-buy-logoBest Buy Stores has been hit with a class action lawsuit alleging the company does not honor its Geek Squad Protection Plans as full warranties.

Plaintiff Nola Touche of Alachua, Fla., filed the Best Buy class action lawsuit on Oct. 19 in Florida federal court. She says she purchased a Samsung television from a Best Buy store on or around Dec. 1, 2012. At the time of the purchase, she also purchased a five-year Geek Squad Protection Plan for $239.99 to provide warranty coverage for the television.

According to the Best Buy class action lawsuit, Geek Squad Protection Plans are sold by Best Buy for coverage of consumer products. Touche says that Best Buy represents to consumers that the Geek Squad plans are warranties but fails to conspicuously state that the Geek Squad plan only provides a “limited” warranty.

Touche argues that the Geek Squad plans are full warranties under federal law. She says the Geek Squad Protection Plans provide coverage for defects, protect against “lemons,” and claim ownership of replaced defective parts.

Touche says the Geek Squad Protection Plans are warranties under the federal Magnuson-Moss Warranty Act because “they provide seamless and almost identical coverage as the manufacturer warranty, stating: ‘After the manufacturer’s warranty expires, this Plan continues to provide the benefits provided by the manufacturer’s warranty (excluding manufacturer’s loaner programs), as well as certain additional benefits as listed within these terms and conditions.’”

According to the Geek Squad Protection Plan class action lawsuit, Best Buy fails to honor its Geek Squad plans as full warranties.

In October 2017, Touche says her Samsung television failed while covered under the five-year Geek Squad warranty. She contacted Best Buy, which sent a representative to her home to diagnose the problem. Best Buy ordered a new part and attempted to install it, but the attempted repair did not fix Touche’s television, the Geek Squad class action lawsuit alleges.

The Best Buy class action lawsuit alleges Best Buy uses its Geek Squad Protection Plan to elect what type of remedy a consumer receives if the consumer’s product cannot be repaired.

“As a result of Best Buy’s unlawful conduct, Plaintiff suffers injury with a failed television and inadequate means to fully assess and/or enforce her rights under the [Geek Squad Protection Plan] and the Federal Minimum Standards for warranties,” the Best Buy Geek Squad class action lawsuit says.

Touche filed the Best Buy class action lawsuit on behalf of herself and a proposed Class of consumers who purchased a Geek Squad Protection Plan from Best Buy since October 2012.

The Best Buy Geek Squad class action lawsuit is seeking injunctive relief, compensatory damages, attorneys’ fees and costs, and other relief the court deems proper.

Touche has asked a judge to order Best Buy to engage in a corrective action to comply with federal warranty laws and ensure that its warranty terms are clearly and conspicuously labeled in its Geek Squad Protection Plans.

I THINK THAT THEY SHOULD BE PAYING FOR THE THINGS THAT I PAID FOR AND THEY DIDN’T GIVE TO US AND OR DIDN’T PUT INTO THE COMPUTERS AT ALL !! I PAID FOR MICRO SOFT OFFICE TO BE PUT INTO MY DESK TOP COMPUTER WHEN WE BOUGHT THE COMPUTER AND IT WAS LEFT OVER NIGHT & THEY DIDN’T PUT IN THE OFFICE INTO THE COMPUTER PLUS WHEN WE BOUGHT THE LAP TOP THEY WERE TO PUT OFFICE IN THAT LAPTOP ALSO AND WAS PAID AT THE TIME OF PURCHASED BOTH OF THE COMPUTERS !!! THEN I JUST HAD TO PAY MORE MONEY OUT TO THEM TO DOWN LOAD IT IN THE LAPTOP WHEN I SHOULD NOT HAVE HAD TO DO THAT ; THEN I WAS TOLD THAT I WOULD ONLY BE CHARGED $50.00 BECAUSE OF THEM NOT PUTTING IT INTO THE COMPUTER AND THAT WAS A LIE BECAUSE I WAS CHARGED THE AMOUNT OF $99.99 THEN TAX IT CAME TO $106.99 ; THEY YOU GOT THEM NOT NOTIFYING US OF THE RENEWAL OF ANYTHING THAT WE HAVE ALREADY PAID FOR WHEN WE PURCHASED THE ITEMS ! SO YES I WOULD LIKE TO KNOW HOW I CAN BE PART OF THIS LAW SUIT PLEASE HELP ME I AM DISABLED WITH A SPINAL CORD INJURY AND BEEN SENT TO THIS PERSON AND THEN THAT PERSON THEY HAVE NOT TRIED TO TAKE CARE OF THE MATTER I EVEN TOLD THEM THAT IT WOULD BE RIGHT TO PUT ON FOR FREE ON THE LAP TOP AND THE DESK TOP COMPUTER ONE FREE YEAR ON EACH ITEMS BECAUSE I HAD ALREADY PAID FOR IT WHEN I BOUGHT THE COMPUTERS ON 11 /09/2017 I WAS INFORMED THAT I DIDN’T PAY FOR IT WHEN I DID AND WHEN WE WERE TOLD IT IS PART OF THE PACKAGE DEAL THAT WE GOT THAT OFFICE AND ANTI VIRUS TO BE DOWN LOAD IT IN TO THE COMPUTERS AND THEY DIDN’T LOAD IT AT ALL THE ONLY THING THAT THEY DID WAS PUT THE ICON ON THE COMPUTERS THAT IS ALL THAT THEY DID WHEN WE BOUGHT THE ITEMS AND NOW I HAD TO PAY FOR THE DOWN LOAD OF OFFICE 365 ON OCT 24 2017 WHICH I SHOULD OF GOTTEN FOR $50.00 DOLLARS LIKE WE WERE TOLD BY ONE OF THE YOUNG MANAGERS AND I WAS THEN CHARGED THE AMOUNT OF $106.99 NO WHERE NEAR $50.00 I CALLED THE HOME OFFICE AND STILL DIDN’T GET ANY HELP AT ALL PERIOD SO I THINK THAT THEY DO NOT HONOR THEIR WORDS AND THEY DO NOT TREAT THEIR CUSTOMERS RIGHT AT ALL ; PLUS THEY LIE AND PUT PLANS ON THINGS THAT YOU ALREADY HAD PLANS ON TO COVER OTHER ITEMS LIKE 3 OR 4 OR 5 OTHER DEVICES AND THEN YOU END UP WITH MORE PLANS THAT YOU PAY FOR THAT YOU DIDN’T KNOW ANYTHING ABOUT AT ALL THAT IS A RIP OFF PERIOD SIMPLE AS THAT THEY DO NOT WANT TO MAKE IT RIGHT AT ALL I WONDER IF THEY ARE GOING TO BE NEXT TO GO OUT OF BUSINESS LIKE CIRCUITY CITY DID AND RADIO SHAKE WHICH IS BOTH SAD

    I bought a 3000 TV and the inside panel under the screen cracked (I’m assuming pressure crack, but it wasn’t on the top surface of screen as it would be if I had damaged it) so the screen is useless it just turns colors… Geek Squad sent someone out and said I was out of luck that they didnt cover it. Why did I even buy the Warranty? It did no good and wasn’t ever able to claim anything. So i have a brand new 3000.00 TV sitting in the living room that is useless… BEYOND MAD my 3 year old and I use an old 80s TV and watch VHS tapes because I can not afford a new one again. It took me 4 years to save that money up. And now I get to look at it every day and be reminded of how I got screwed over by Best Buy and why a single mom, who lost her mother to cancer, 6 months later her sister to luekemia, who works two jobs and is in school full time, and the only person my son has is me, can’t even get him a dang real TV.

    I bought geek squad protection when I purchased my digital camera but I didnt help when I had issues with the camera even after they claimed it was repaired.

    Purchased an Asus $1200 zenbook due to extended Geeksquad warranty. Power cord pin with diameter of very thin needle snapped off inside zenbook causing entire $300 motherboard to need replacing when pc was only 6 months old. Took machine to Best Buy who stated pc had to be shipped to another state for repairs. Due to taking classes online with finals beginning in two weeks, I was forced to purchase a reconditioned laptop for $300 to stay current on college courses. Reconditioned laptop was a piece of junk that continually crashed, making it almost impossible to complete 4 classes, one with a lab. Finals were now in progress which online amounted to hours and hours of writing. HURRAY! Best Buy called and stated Zenbook was ready for pick up. Due to this I delayed starting finals a few days, loosing time, but knowing I could complete work much faster with Zenbook. My oldest daughter drove the 45 minutes to Best Buy to pick up my zenbook due to my being ill and unable to drive. Best Buy had zenbook for 30 days, and when I opened the sealed box Best Buy had placed Zenbook in, I found a note attached to outside of pc, which stated $30 was due for repair, which had not been done. Best Buy had not contacted me concerning this, and no money should have been required under warranty, but I certainly would have paid the $30 to get zenbok back repaired. I do not believe pc was sent anywhere for repairs, and warranty was a complete scam, due to when pc was taken in for repair, store manager came to service desk, and attempted to use three different tactics to squeeze money out of me, changing reason for charge each time I disputed what he was claiming, and pointed out in warranty what was stated. Best Buy employees are a bunch of scamming scumbags. Due to businesses such as Circuit City closing, increasing Best Buy’s sales through the roof, they seem to feel that they can lie and cheat consumers.

    We purchased a Lenovo laptop with geek squad warranty that came pre loaded with the superfish malware. Called the geek squad to remove malware and they wanted nearly $150.00 to clean up the PC.
