Consumers who purchased Barbara’s Bakery food products are receiving checks in the mail this week from a class action lawsuit settlement over false advertising allegations.
Viewers are reporting on TopClassActions.com’s Facebook page that checks worth an average of $45.82 were mailed Friday to Class Members who participated in the Barbara’s Bakery class action settlement.
The Barbara’s Bakery settlement checks are from a class action lawsuit (Trammell v. Barbara’s Bakery) that alleged the company mislabeled its cereal and snack products as “all natural” when they actually contain genetically modified (GMO) ingredients.
Barbara’s Bakery denied any wrongdoing but agreed to a class action settlement to resolve the litigation. A California federal judge granted final approval to the deal in November 2013. Under the terms of the class action settlement, Babara’s Bakery agreed to remove the terms “all natural,” “no artificial additives,” “no artificial preservatives” and “no artificial flavors” from its packaging on foods that contain artificial ingredients.
The company has since removed GMOs from its products.
The Barbara’s Bakery settlement also allowed U.S. consumers who purchased eligible Barbara’s Bakery products from May 23, 2008 through July 5, 2013 to claim up to $100 in reimbursements. The deadline to file a claim was Jan. 1, 2014. [See our claim filing instructions here.]
According to TopClassActions.com viewers, the max amount awarded fell short of the $100 estimate, at $45.82 per claim. Claims were calculated on a pro rata basis, which means more claims were filed than predicted.
