Pampers Pure Diapers Class Action Lawsuit Overview:
- Who: A New York mom is suing Procter & Gamble.
- Why: She says the Pampers Pure line of “plant-based” diapers she bought for her baby are falsely advertised because they contain more plastic made from petrochemicals than any other material.
- Where: The mom is looking to represent consumers in New York, North Dakota, Kansas, West Virginia, and Wyoming.
Procter & Gamble sells a range of Pampers baby diapers advertised as “plant-based” that are in fact mostly made from petrochemicals, a New York mom alleges in a new class action lawsuit.
Lead plaintiff Angelina Almanzar filed the class action complaint against Procter & Gamble Company on Nov. 7 in a New York federal court, accusing the company of breach of warranty and fraud.
Almanzar says Procter & Gamble sells disposable diapers marketed as “Pure” with a “Plant-based liner enriched with shea butter,” under the Pampers brand.
However, according to laboratory analysis, the diapers are actually only 22 percent plant-based, with the remaining 78 percent of the diaper’s material made from petroleum, Almanzar says.
Almanzar says she is a mother with a young child in diapers.
She says, when she bought the diapers at a premium price, she did so because the description of the product as “Pure,” with green shades dominating the front label, gave her the impression it had a significant amount of plant-based materials compared to fossil fuel-based materials
She says disposable diapers often incorporate polypropylene or polyethylene, which are plastics from petroleum.
Pampers Pure Dupes Environmentally-Conscious Consumers, Alleges Class Action
Pampers Pure diapers release carbon dioxide when they are burned and offer no net sequestration of carbon if they are put in a landfill. The estimated carbon dioxide emissions from all disposable diapers used by babies in the United States is 2.7 million tons annually, the lawsuit alleges.
At least a quarter of parents have reported trying to make environmentally-conscious purchasing decisions to reduce the harm, Almanzar says.
However, according to reports, the Pampers diapers have “only slightly more plant-based materials than standard products from Defendant that are not advertised as plant-based.”
Almanzar is looking to represent anyone in New York who bought the diapers, plus a Class of anyone in North Dakota, Kansas, West Virginia, and Wyoming who bought Pampers Pure diapers.
She’s suing for breach of warranty, fraud, and negligent misrepresentation and seeking certification of the class action, an injunction, damages, fees, costs, and a jury trial.
Procter & Gamble faced similar claims over their “natural” baby wipes in recent years. Another New York consumer lodged a class action lawsuit alleging Pampers Natural Clean wipes, sold at a premium, actually contain synthetic ingredients similar to their regular and less expensive option.
This is not the only diaper company facing class action either. In August, a lawsuit was filed alleging Huggies Snug and Dry diapers can give children rashes and cause blistering, peeling, and chemical burns.
