Gerber baby food products contain a dangerous amount of toxic heavy metals including arsenic, lead, cadmium, and mercury, a new class action lawsuit alleges.
Plaintiff Beth Hartwell-Dennis claims Gerber “sacrificed the health and safety of infants, children, parents, and caregivers, to increase corporate revenue.”
Hartwell-Dennis wants to represent a nationwide Class and New Jersey subclass of consumers who purchased one or more Gerber baby food products for personal or household use.
The plaintiff says she was under the false impression that the Gerber baby food products she regularly purchased were safe for infant consumption.
Gerber, along with Walmart and multiple other baby food producers, were implicated in an investigative report released in February by the Subcommittee on Economic and Consumer Policy Committee on Oversight and Reform of the US House of Representatives.
The subcommittee determined Gerber — which is facing multiple complaints — ignored established standards and sold its baby food with dangerously high levels of toxic heavy metals.
Hartwell-Dennis claims Gerber has been concealing from consumers that its baby food contains a dangerous amount of toxic heavy metals.
“Defendant lied to Plaintiff and millions of consumers and broke their trust and faith, by actively marketing and selling baby food products as safe,” states the class action lawsuit.
Gerber Knowingly Sold Toxic Baby Food, Says Class Action Lawsuit
Toxic heavy metals are especially hazardous to infants and young children, according to the class action lawsuit, which claims exposure can lead to behavioral issues, intelligence loss, and nervous system issues.
Hartwell-Dennis alleges Gerber is in violation of the New Jersey Consumer Fraud Act and guilty of breach of express warranty, breach of implied warranty of merchantability, negligent misrepresentation, and unjust enrichment.
The plaintiff is demanding a jury trial and requesting compensatory damages, punitive damages, and declaratory and equitable relief for herself and all Class Members.
