Avem Health Partners agreed to a $1.45 million settlement to resolve claims it failed to prevent a 2022 data breach that compromised patient Social Security numbers and insurance information.
The settlement benefits individuals who were notified by Avem Health Partners — a hospital management company — that their personal information and health data may have been compromised in a May 14, 2022, data breach.
Plaintiffs in the Avem Health Partners data breach class action lawsuit claim the company failed to protect their information. They argue Avem Health negligently allowed hackers to access sensitive information such as birth dates, Social Security numbers, health insurance and protected health data. According to the data breach class action lawsuit, Avem Health could have prevented the data breach by implementing reasonable cybersecurity measures.
Avem Health hasn’t admitted any wrongdoing but agreed to a $1.45 million settlement to resolve the claims against it.
Under the terms of the settlement, class members can receive up to $7,000 in reimbursement of data breach-related losses such as bank fees, credit expenses, fraudulent damages, identity theft losses and up to five hours of lost time at a rate of $25 per hour. Class members who do not have data breach losses to claim or who do not wish to claim such losses can instead opt to receive an alternative cash payment of $100.
All class members are eligible for three years of identity theft protection and credit monitoring services. These services include three-bureau credit monitoring, credit alerts, fraud resolution resources and up to $1 million in identity theft insurance.
The deadline for exclusion and objection is April 25, 2024.
The final approval hearing for the settlement is scheduled for May 10, 2024.
In order to receive settlement benefits, class members must submit a valid claim form by May 25, 2024.
