Crystal Bay Casino agreed to a $675,000 settlement to resolve claims it failed to protect consumers from a 2023 data breach.
The settlement benefits individuals who received a data breach notification from Crystal Bay in February 2023 informing them their information may have been compromised in a cyberattack.
According to the data breach class action lawsuit, Crystal Bay failed to secure its systems, which allowed hackers to gain access to current and former customers’ sensitive personal information. Plaintiffs in the case argue Crystal Bay could have prevented the breach by implementing reasonable cybersecurity measures.
Crystal Bay Casino is a hotel and casino near Lake Tahoe in California.
Crystal Bay Casino hasn’t admitted any wrongdoing but agreed to pay $675,000 to resolve the data breach class action lawsuit.
Under the terms of the settlement, class members can claim up to $500 in ordinary expenses, including bank fees, communication charges and up to five hours of lost time at a rate of $20 per hour.
Class members can also claim up to $10,000 in extraordinary losses such as documented, unreimbursed losses linked to identity theft or fraud that occurred between June 1, 2022, and June 4, 2024.
Class members who do not wish to claim actual data breach-related losses can instead receive an alternate cash payment between $25 and $50. Exact alternate cash payment amounts will vary depending on the number of participating class members.
All class members are eligible to receive three years of one-bureau credit monitoring services with $1 million in fraud protection.
The deadline for exclusion and objection is May 6, 2024.
The final approval hearing for the Crystal Bay Casino data breach settlement is scheduled for Aug. 5, 2024.
In order to receive settlement benefits, class members must submit a valid claim form by June 4, 2024.
