AT&T Residential Internet Billing Class Action Lawsuit

By Matt O’Donnell

AT&TAT&T customers have filed a class action lawsuit against the company to stop its “unlawful practice of systematically overcharging customers for residential Internet service” by promoting plans for $19.95 a month, but then charging them $40 a month for either the entire year or a portion thereof.

“AT&T advertises many promotional plans at reduced rates for residential Internet service and then bills those who sign up for the promotions at the standard higher rates,” claims the AT&T Internet class action lawsuit. “Unfortunately, AT&T has breached its contracts with its customers of AT&T Residential Internet service by failing to live up to the terms offered and accepted.”

The crux of the problem, the class action lawsuit says, stems from AT&T not applying the bill credit within the first two billing cycles and then either not apply the credit at all, thus forcing the consumer to pay the standard rate for the entire duration of the contract, or applying the bill credit for only a portion of the contract duration, thus forcing the consumer to pay the higher standard rate for some of the months.

“As a result, consumers only receive the promotional pricing for 0 to 11 of the first 12 months of service, rather than 12 of the first 12 months, even though they contracted to receive the promotional pricing for 12 of the first 12 months of service,” the class action lawsuit states.

The AT&T Internet plan class action lawsuit is brought on behalf of anyone in the U.S., and a subclass of individuals who live in Illinois, that signed up for a promotional rate plan for residential Internet service with AT&T but were charged the standard rate for all or part of the duration of the promotional rate period between July 26, 2007 and the present. It is seeking economic, monetary, actual, consequential and compensatory damages in addition to other relief for alleged Breach of Contract, Violations of the Illinois Consumer Fraud and Deceptive Business Practices Act, and Unjust Enrichment.

Every month with ATT I had a data plan exceeded charge. Although it was supposed to be unlimited there was a cap. It was very deceiving. Is there any suit going on against this practice? I no longer am with them. Thanks…

  2. Gregory Johns says:

The lied about the bundle I signed for. 250 channels plus 50 high speed internet for $85 and my bills are always a around $135.00. No taxes in any state are that much to make my bill so high!!

  3. Denese says:

I signed up with AT&T . The contract was $20.00 a month for 3 years . Y first bill was almost $300.00. I had to talk to several managers. It will be fixed in few days we give you rewards. They finally said $40.00 per month. Is 6 months and they want to raise it again to $80.00. I don’t know what to do anymore. Internet was designed to be free ..

I had to contact them again today after I got billed again. I cancelled my service with them on 11/20/18 after being over charged continuously and poor service. I was told once again that it would be credited. Unfortunately for them, I keep very good records and have even the letter they sent me in June stating the amouont I was to be charged which was $20 less than what they had been and continued to charge me. I have the chats printed out where they promised to take care of the issue and never did. The only thing you cannot record is when they escalate it to a supervisor who calls you and promises everything they can that you never see come to pass either. Right now they owe me $160 in over charges that I know I will never see, but I be darned if I will give them another dime. I want to be added to the class action suit against them. My service rarely worked and was slow when it did, much like dial up. They told me and neighbors that they were not planning to upgrade equipment or lines in our area and were actually not offering service out here any longer. They had promissed me five years ago that they were bringing UVerse out here and that is the only reason I chose them to begin with. Not only did they not do that, but the service they did have was awful. The main box for the neighborhood is always full of ants and technicians have to clean them out and fix wires regularly. We thought when they were in the neighborhood cutting lines down they were getting ready for installation of UVerse. However, we soon learned they taking their lines out so no one else could use them. I am very disappointed in this company after having been a loyal customer for nearly 20 years before moving here and then 5 more years since relocating to this area. Never again will AT&T get my business in any aspect.

  6. Irina Arriaga says:

AT&T is a fraudulent company. AT&T stopped offering the plan it provided us. The internet was performing so poorly that we started to contact its technician almost every week to get the issue resolved. Technicians stated that the equipment was faulty and that there was nothing they could do for us. We asked them to get the equipment replaced, we were even willing to purchase new equipment, but they could not provide the equipment because the plan was no longer offered. We were forced to terminate services and had to pay a cancellation fee, even though they were no longer offering the equipment we needed for the plan we enrolled for. Someone needs to do something, AT&T is stealing from people and it is not being accountable for it. We need to do something! AT&T deserves a major CLASS ACTION LAW SUIT.

  7. Helen Horton says:

My trouble with AT&T has went on for at least a year. They caused me to lose my work at home job because my internet kept going out. I am disabled so I have to work at home. I have not been able to get another job since. Also, EVERY single month my bill would be over $300 or close to it! I had to call them constantly and stay on the phone with them forever to get an adjustment, often using all my phone minutes. I filed a dispute threatening to sue them because my disability is PTSD, Major Depressive Disorder, severe anxiety with panic attacks. I told them they had caused me tremendous anxiety and my panic attacks were awful when I would get their bill. A guy called me with a condescending attitude and said, “We don’t give reparation for emotional issues”. I said, but I lost my job because of y’all and can’t get another. You should at least have to pay me some kind of settlement for that. He laughed and said, “So sue us” I NEED ADVICE! IS THERE ANYTHING I CAN DO?

  8. Dora Saulny says:

Please add me to this lawsuit.

  9. Nancy says:

At&t is still full of lies I was told there was no limit on their internet services and then I started getting e-mails that I had reach my max for that month. When I contacted the person that sold it to me she said there was not a max if you bundled. I said ok. Yesterday I called them because I got two e-mails in one day about them charging me $10.00 more for 50 more gb, that’s when I found out getting a telephone and interned is not a bundle even thought that was not explained and my bill and dash board says it is a bundle. Today is the 5th one this month and the month is not even over. This is robbery. I wish I could press charges against them for that. I explained before I got it that I didn’t want anything with a limit because I have 3 teens and 3 adults that stay on the internet, Everything from home security to the can opener is on the internet so why would I buy something that has a cap. #sick of AT&T lies

  10. Lucretia Bluester says:

At&t is very bad and mislead A lot of people with their internet, How much the bill will be and promotions I’m sick of them but am in a contract now and if I want out of it i have to pay damn near 500.00 plus the last bill shameful people
