Ashley-Furniture-HomeStoreSeveral New Jersey Ashley Furniture HomeStore locations are accused of failing to list promised delivery dates on the sales documents, even after the owner of the stores agreed to do so under a settlement of similar claims.

Plaintiff Daniel Wolf alleges he purchased a bedroom set from an Ashley Furniture store in North Brunswick, N.J., on Feb. 20, 2017.

He told the salesman that he needed the furniture by March 1, 2017 for his new apartment, and was told that this delivery date would not be an issue, the Ashley Furniture class action lawsuit says.

However, the sales contract noted that the furniture delivery date was “TO BE SCHEDULED ASAP.” Several days later, Wolf was given a promised delivery date that was more than two weeks later than the delivery date he requested, according to the Ashley Furniture class action lawsuit. He was allegedly told that he could not get an earlier delivery date.

“Plaintiff paid rent and utilities for the first 15 days of March 2017, but was unable to live in his new apartment as a direct result of the furniture not being delivered until March 16, 2017,” the Ashley Furniture HomeStore class action lawsuit states.

When the furniture was delivered, the Ashley Furniture representative allegedly required Wolf to enter his signature into a small electronic device. Wolf says he was told that his signature was needed to acknowledge the furniture was delivered, but he was not given the opportunity to read what he was signing.

According to the Ashley Furniture class action lawsuit, the sales document Wolf was provided by Ashley Furniture did not comply with the furniture delivery regulations related to notice of the promised delivery date. The defendants had previously agreed to abide by these regulations under the terms of a class action settlement that received final approval in January 2014.

Wolf accuses the Ashley Furniture HomeStore defendants of violating the New Jersey Consumer Fraud Act; the Truth-in-Consumer Contract, Warranty and Notice Act; and Delivery of Household Furniture and Furnishings regulations.

According to the Ashley Furniture HomeStore class action lawsuit, the Furniture Delivery Regulations require sales documents to show the date of the order and the promised date of delivery. The date of delivery must be filled in by the seller at the time the sales contract is entered into, and it may be a specific day or as a length of time that is agreed upon by the buyer and seller.

Wolf seeks to represent a Class of New Jersey consumers who purchased furniture from any of the six Ashley Furniture HomeStore locations in New Jersey and who were promised a future delivery to a residential address within the last six years, and where the defendants used a sales document that did not comply with the Furniture Delivery Regulations because they failed to indicate the specific date or mutually-agreed upon length of time for delivery.

    I to would like to be added to this effort.

    We have been waiting since September of 2021 for the furniture ordered at that time.
    We inquired in mid January and were informed that the furniture would in fact be delivered on the 21st of January. We were subsequently informed
    three days prior to the agreed upon delivery date that the furniture would not be delivered until late February. On February 22. Ashley informed us
    once again that the furniture would not be delivered until the May time-frame.

      Don’t except any furniture, they delivered to me the floor model. I’m not wanting to join this class action suit. I’ll be also going to Better business bruel.

    I would like to sue City Furniture in FL. They delivered almost all items after 3 months. I paid extra for warranty. The Nixon couch sinks in. It got totally flat in less than a year. I complained and they sent a technician. He confirmed it’s defect. He said I’ll get a new couch soon. Then customer service people told me to wait for 3 months! I injured my back, neck and shoulder because of sitting on this defect couch. I ended up going to chiropractor 5 times and started physical therapy for the first time in my life. I was in extreme pain for 2 weeks. I try not to sit on this couch but it’s the only couch I have so I have no other option. I sent email to their attorneys, filed complaint with BBB and FL department of consumer services. I’m sure there are many customers like me who purchased Nixon couch. This couch is probably made in China and it’s terrible. We have to sue this company that doesn’t care for us and our health.

    i would like to join this as well. if this one has been settled i would like to start a new Lawsuit. I’ve waited 3 months for my furniture, only for it to arrive damaged and now I’m getting the run around because i want a refund.

    I purchased a Living Room And bed room Suite back Dec. 4 2020 and I still don’t have all of my furniture they keep putting it off a other month. I payed in full I would like to know if they would like to Wait for there money that long.

    How do we also become apart of the lawsuit? I would like to join as I have also been scammed by Ashley’s Furniture. When they finally delivered the furniture it was damaged. Now that I want to return it, they want to charge me additional fees for damaged furniture.

    They also would not answer the phone and delivered my furniture over 10 weeks late.

      I would like more information on how to join. I purchased and paid in full for a complete bedroom set in November on 2020. I’m still waiting for my furniture that is not damaged.

      My first delivery the driver was stoned and reeked of marijuana. During the delivery, they damaged my walls and ceiling. And delivered furniture with chucks of wood missing, scratched up, poorly made furniture.

      Replacements were requested and the prices slowly trickling in however still damaged products and more damages to my house during deliveries. I’m still waiting for three prices to be exchanged.

      Ive spent countless hours dealing with customer service, escalation teams and delivery department.

      I spent days off waiting for no show deliveries and then received deliveries unscheduled. Ever time a different story is told.

      Ive request a credit for all the issues and been waiting since November 2021 and still no reply!

    Include me please in the class action against Ashley Furniture. I purchased a King size bed on Jan, 2, 2021 was promised the bed would be available in 4-12 weeks according to the sales receipt, now it’s July almost 24 weeks later still no bed! Ashley Furniture called on June 25 and scheduled delivery for July 5 even gave me a confirmation time for July 5 only to call me on the “DATE OF DELIVERY” to cancel! I’m so frustrated ! I’ve tried reaching out to Ashley Furniture! I’ve made several calls ! I’m yet to receive a call to get information on my bed ! I WILL NEVER SHOP at this store again WORST experience ever !

    I purchased a sectional, ottoman and rug back in March and I still have not received it. I have gone back into the store twice and they screwed up because they took my money out of my count but forgot to have me sign one of my receipts. They put it on hold and pushed it back 2 more weeks to be delivered.Fast forward 2 months I have a ottoman and rug but still no sectional. I called back in since ithe sectional should have been here and they pushed out another 4 to 6 weeks The best response I could get from a manager was that they could give you a $75 credit but I have to go back into the store and give them my debit card to have them put it back on it I would never order from them again.

      I unfortunately paid in full for a bed frame and mattress in april 2021 an to date am still waiting for it to be delivered its going on 4 months they said it was back ordered and because of covid i stayed home today cause i had a scheduled delivery for the 8th time still something happened again bs story of why they cant deliver im so frustrated i need this bed it expensive 1600.00 plus other stuff they added to it i dont make alot of money so im stuck what can i do i feel like crying i cant belive they r robbing me out of something i really needed how can they get away with this i wish i would have researched more before giving them my littel bit of money they even lied said that they wereoutsidewaiting that was such a lie i was home i was checking how can they get away with this someone please call me 3237380420 8 dont know who to call or what to do i got scammed at Ashley s furniture in burbank c.a.

    I ordered from Ashley furniture store in person bought a sofa called Alesandra in the color vanilla when it did not come on promised delivery date I call an spoke to several people there was always promised that the problem would be solved but to my surprise some of my furniture was delivered but not the sofa. Being that I called and complained again by this time they knew my name very well later I got an email that my sofa would be delivered on 05/07/2021 when it came it was not the color or the sofa I bought at all it was gray and an arm on right side under fabric was missing a support section of wood not there needless to say they had me sign off on this sofa not knowing what I had signed I call back to speak to a manager and was told I had to wait till Monday to have this sofa taken and replaced with what I had ordered that did not happen . Then come Monday I called them back and now this so “called” apparently was off that day so now I was told I would have to wait for the sofa to be returned before they can credit my credit card payment for delivery delays. Now I’m told I have to come back to the store to reorder another sofa or take store credit. Nope Ashley furniture in Buford ga is a scam and should be put out of business for fraudulent sales tactics. I did however report this to the BBB and chase credit card for reimbursement. I will never do business with them ever again, they are to me considered to be a legal criminal enterprise.
