Asbestos Lung CancerBurlington Northern Santa Fe (BNSF) Railway Company and Robinson Insulation are facing an asbestos lawsuit, from a grieving husband who alleges his wife had suffered childhood asbestos exposure.

BNSF Railway, Robinson and other associates have been named as defendants in this asbestos lawsuit, with the widower claiming that the companies had bought asbestos materials while being aware of the risks they imposed onto their customers.

Washington plaintiff Timothy M. is filing this asbestos lawsuit on behalf of his late wife, Susan M., who allegedly died of asbestos cancer. After being diagnosed with mesothelioma, a form of lung asbestos cancer, Susan ultimately died from the disease on Nov. 06, 2012.

Upon discovering the adverse effects of asbestos exposure, Timothy filed this asbestos lawsuit against BNSF Railway and Robinson for allegedly causing the death of his wife. According to his asbestos lawsuit, Susan had lived next to railroad tracks owned by BNSF from 1962 to 1964 during her childhood.

During that time, Susan had been exposed to asbestos fibers on a daily basis due to railroad tracks and other products made from asbestos. The asbestos lawsuits points out that Robinson Insulation had bought different asbestos materials from Lincoln County, Montana.

This county is now well known for the asbestos contamination of the Grace Mine, which has reportedly claim a number of miners’ lives from asbestos cancer. According to the asbestos lawsuit, 14 Grace Mine workers had died of asbestos cancer by 1971.

The asbestos lawsuit further alleges that Susan had experienced asbestos exposure throughout her childhood, which led her to eventually be diagnosed with mesothelioma.

Overview of Asbestos Exposure Dangerous

Asbestos is a fibrous material that was used popularly for its chemical and fire resistant qualities before the 1980s, for insulation and other manufacturing purposes.

However after it was discovered that asbestos exposure could lead to serious health conditions, numerous patients have been diagnosed with either mesothelioma and asbestos lung cancer. Mesothelioma is a rare lung asbestos cancer, which specifically attacks the mucus lining of the lungs.

Similarly, asbestos lung cancer also affects the lungs but the organ takes the brunt of the cancer cells. When the patients had inhaled the asbestos fibers, typically sometime during childhood, the fibers became embedded in the lungs and festered after enough time had passed.

Oftentimes patients with mesothelioma or asbestos lung cancer are diagnosed at a latent stage, because it can take up to 30 years before patients may experience any symptoms. Susan was no different with her asbestos lung cancer diagnosed at a latent stage, giving her little treatment options and a severely shortened life expectancy.

Timothy is filing this asbestos lawsuit on behalf of his deceased wife, and is seeking damages against the companies for wrongful death and negligence. Timothy states that the defendants knew the risks of asbestos exposure, but did nothing to warn their workers or customers.

The Asbestos Lawsuit is Case No. ADV-14315, in the U.S. District Court of Montana Eight Judicial District Court, Cascade County.
