Apple Inc. violates consumers’ privacy by unlawfully recording and sharing consumers’ personal data even after they indicate they do not want their information shared, a class action lawsuit alleges.

Plaintiff Joaquin Serrano filed the Apple data privacy class action lawsuit Jan. 6 in Pennsylvania federal court and says the case is challenging “a flagrant violation of consumer privacy.”

Serrano says Apple tracked his mobile app usage after he changed his privacy settings to indicate he did not want his information to be tracked or shared.

In response to consumers’ growing concerns about data privacy, Apple touts how its mobile devices allow consumers to control the information they share, Serrano alleges.

He points to the Apple data privacy policy, which states: “At Apple, we respect your ability to know, access, correct, transfer, restrict the processing of, and delete your personal data.”

Apple also allegedly claims in its policies that apps available in the App Store “are held to a high standard for privacy,” and that “nothing is more important than maintaining users’ trust.”

The Apple class action lawsuit notes Apple provides specific instructions for consumers to control the data it collects and shares. However, Apple fails to honor these requests, Serrano says.

Tests reportedly show Apple data privacy not protected even when users update privacy settings

Two independent app developers reportedly tested Apple’s privacy settings and learned that Apple continues to record, track, collect and monetize consumers’ browsing history, activity information and other analytics data even when they have updated their privacy settings.

Multiple news outlets have reported on this data privacy violation since November 2022, Serrano says.

Serrano filed the lawsuit on behalf of himself and a proposed class of individuals using an Apple mobile device in Pennsylvania who had their information tracked or intercepted after utilizing Apple data privacy settings intended to prevent data tracking and sharing.

The Apple data privacy class action lawsuit asserts claims for violations of Pennsylvania’s Wiretapping and Electronic Surveillance Act, Unfair Trade Practices and Consumer Protection Law, Invasion of Privacy – Intrusion Upon Seclusion, breach of implied contract and unjust enrichment.

A recent Apple class action lawsuit alleges the company misleads consumers by not including chargers with the sale of a new iPhone device.
