If you have placed or received a call from an American Airlines customer service, lost baggage, cancellation, or emergency number, your call may have been recorded in violation of call recording laws.
California residents who have received calls from certain businesses may be eligble for legal action due to recent allegations that the businesses could be recording calls without consumer consent. Although no company-specific allegations have been made, businesses under investigation include British Airways, Czech Airlines, Dermalogica, Fisher & Paykel, Harman Audio, Hunter Boots, JBL Audio, Malaysia Airlines, Tupperware, and Romano’s Macaroni Grill.
Should an investigation find that these or other companies have been recording calls without consent, California consumers may be eligible for legal action. The companies may be held accountable for violation of California call recording laws.
In California, privacy is considered an inalienable right and is protected under the California state constitution. The state has the strictest state privacy laws in the country, and in 1967 passed the California Invasion of Privacy Act. This law protects California citizens from breaches of privacy through various means including online, in person, and through phone calls.
Under the California Invasion of Privacy Act, people and businesses are not allowed to record telephone calls without the consent of all parties participating in the call.
California call recording statutes forbid “maliciously and without the consent of all parties to the communication, [intercepting], [receiving], or [assisting] in intercepting or receiving a communication transmitted between cellular radio telephones or between any cellular radio telephone and a landline telephone”. Similar statutes are in place for communication between other telephone devices.
If consumers received calls from American Airlines customer service and did not receive a warning that their call was recorded, the call may have been recorded without consent. Businesses are required to disclose if they are recording calls at the immediate start of the call. Generally speaking, if a consumer stays on the line after a call recording warning it is considered consenting to have their call recorded. However, if a warning was not given, businesses may be liable for damages, even if the call was recorded for training or quality purposes.
Should a call recording lawsuit find that businesses recorded calls without consent, the law dictates that plaintiffs may be eligible for damages up to $5,000 per violation, or three times the amount of damages suffered. Instead of risking the costs of litigation and potential damages, businesses may choose to settle lawsuits before they go to trial. Several businesses have already paid millions of dollars to settle call recording lawsuits alleging violations of California privacy laws.
Consumer advocates are concerned that calls from an American Airlines customer service, lost baggage, cancellation, or emergency number may have been recorded without the proper notice and consent. If you believe your American Airlines customer service call was recorded without your consent, you may qualify for a California call recording lawsuit. California call recording litigation can potentially recover compensation for damages, breach of privacy and more.
If you live in California and you did not receive a warning when calling a toll-free number, your call may have been recorded in violation of California law, and you may be entitled to compensation. See if you qualify to file a California call recording class action lawsuit.
