Amazon class action alleges Happy Belly canned fruit, bowls falsely advertised as 100% juice

Amazon.com Services LLC sells Happy Belly products that are falsely advertised as containing 100% juice even though they contain synthetic ingredients, according to a class action lawsuit filed Oct. 6 in New York federal court.

Plaintiff Lofera Legrier says she has purchased Happy Belly 100% juice products from Amazon on several occasions. She claims she relied on Amazon’s representations that the products contained 100% juice when she decided to purchase the Amazon Happy Belly products over comparable products that did not purport to contain 100% juice.

However, products advertised as Happy Belly 100% juice actually contain citric acid and/or ascorbic acid, which the Amazon class action lawsuit says are “two well-documented synthetic ingredients.”

The Happy Belly products listed in the complaint include the following fruit bowls and canned fruit products: Yellow Cling Diced Peaches in 100% Juice, Diced Pears in 100% Juice, Cherry Mixed Fruit in 100% Juice, Mandarin Orange in 100% juice and Yellow Cling Sliced Peaches in 100% Fruit Juice.

Amazon misleads consumers with Happy Belly 100% juice claims, plaintiff says

Legrier claims Amazon markets its Happy Belly products in a “systematically misleading manner.” She points to the packaging of the products, which includes display windows to show the fruit and the juice in the product next to the language stating: “in 100% juice.” 

The Amazon class action lawsuit claims consumers are increasingly interested in purchasing natural juices due to their perceived health benefits. Recent consumer surveys reportedly indicate that many Americans seek products that contain no artificial ingredients.

“By labeling its products as being contained ‘In 100% Juice,’ (Amazon) deceptively attempts to distinguish itself from other fruit juices that do contain additional synthetic ingredients or preservatives,” misleading consumers into thinking the products do not contain synthetic ingredients, Legrier says.

“As a result of its deceptive conduct, (Amazon) is, and continues to be, unjustly enriched at the expense of its consumers,” Legrier alleges.

The Amazon class action lawsuit asserts claims for violations of various state consumer protection statutes and New York’s General Business Law.

Last year, Amazon was hit with a class action lawsuit alleging it fails to disclose the presence of toxic heavy metals in Happy Belly spices.
