Amazon Prime class action lawsuitAmazon.com LLC has been hit with a class action lawsuit filed by a woman who says the online retail giant failed to cancel an Amazon Prime membership that was charged to her bank account without her authorization.

Plaintiff Latoya Christmas says that her debit card was used without her consent to purchase goods from Amazon.com in September 2016. The same card was used to sign up for a $99 Amazon Prime membership, the Amazon class action lawsuit states.

On Sept. 29, 2016, Christmas reportedly called Amazon to notify the company that unauthorized purchases had been charged to her debit card. She requested cancellation of the Amazon Prime membership. According to the Amazon.com class action lawsuit, Amazon agreed to cancel the Amazon Prime membership and refund the $99 fee to Christmas’ debit card.

Christmas believes that Amazon would have continued to take additional unauthorized recurring payments from her bank account if she had not called to cancel the Amazon Prime membership, even though she had never provided Amazon with consent to deduct funds from her account on a recurring basis.

The next day, Christmas says Amazon withdrew another $99 from her bank account for a recurring Amazon Prime membership. She immediately called Amazon to have the charges refunded, but the retailer failed to refund the money, the Amazon class action lawsuit alleges.

According to the Amazon class action lawsuit, Amazon “concealed, suppressed and/or omitted” the fact that Christmas’ bank account would be debited another $99 annual membership fee even though she had cancelled the Amazon Prime membership.

Christmas claims she never provided Amazon.com with any authorization to deduct the Amazon Prime membership fee from her account. According to the Amazon class action lawsuit, she did not provide the retail giant with any written or electronic communication that authorized these recurring payments.

By filing the Amazon Prime class action lawsuit, Christmas seeks to represent herself and a Class of consumers whose bank accounts were debited by Amazon after Amazon had received a cancellation request for the Amazon Prime membership. She also seeks to represent an Illinois subclass.

The Amazon.com class action lawsuit asserts violations of the Electronic Funds Transfer Act and the Illinois Consumer Fraud and Deceptive Business Practices Act.

“In multiple instances, Defendants debited bank accounts of the Class and the Sub-Class members on a recurring basis after the consumers requested to stop payments of preauthorized electronic fund transfers from the consumers’ accounts by notifying the financial institutions orally or in writing at least three business days before the scheduled date of the transfers, in violation of the EFTA,” the Amazon class action lawsuit states.

Christmas is seeking statutory damages of $1,000 per violation of the EFTA, actual and punitive damages, attorneys’ fees and costs, and other relief deemed appropriate by the court.

    Amozon prime just charged my account for 99$ when I didn’t order it. Now I have to wait 1-3 days to get my money back. It’s saturday. And that’s all I have in my account . Can I sue them for this ? I ordered something two weeks ago but not prime. This is bull sht now I’m at a disadvantage for three days

    I had someone hack my account charge a bunch of things amazon refused to refund the digital stuff and my bank refunded it. Amazon continues to try to collect from me and has even listed my kindle device as lost or stolen soi can’t use it or even sell it! All because of some fraud on my account amazon lost a customer, and when calling the representative was rude referred to me as them people refused to let me speak with a supervisor. It was horrible!

      I same happened to me they also closed my account an still charging my account even after they closed it an I can’t sign in or nothing to get off my info an wen I call they give a run around

    I am a disabled senior citizen on a fixed income. I am so pissed that Amazon takes $53.53, each month out of my account. I have not ordered Amazon prime, nor do I want it. Everyman the I have to call them for a refund. Why is it that it takes them only a matter of seconds to take my money, but days to replace it?

    They did that to me 3 times in one year i was on hold for 30 min each time.they overdrafted my bank account which cost me over one hundred dollars they took 10 day to refund my mone when they said 3 days im disabled and now i dont use them any more because they dont want to help u.i have 3 friends who worked for them and they say its not very helpful with any thing.they owe me i figure almost 500.00some one needs to help us all.

    Since this website won’t let me file a class action lawsuit about Amazon’s system of charging people for content that they did not order, how about “ghost charges” from Amazon. We have this fee withdrawn from our bank account, but when we call Amazon about it, they, 1. Can’t find any order associated with the amount taken from the account, 2. Will not help us even though the email address, address, etc are not the same as what is associated with the bank account in an obvious case of fraud, and when we give the correct information that is supposed to associated with the account, it is wrong, 3. Show that the charge is for digital content, but have no identifying information other than that, 4. Have this charge show up as withdrawn from your bank account as a “ghost charge”. 5. Refuse to give us a refund of the amount that we are disputing. Of course, we We are hoping that this is not an Amazon Prime issue, but with the way that Amazon Prime is set up (so that people accidentally purchase this, then get stuck with recurring charges), you never know, and Amazon isn’t telling! As it stands now, I refuse to do business with Amazon.

    My boyfriend and I were charged for prime and we didn’t authorize payment. We didn’t even know. Tell I found the charges on our bank statement. They never refunded the

    Last year I joined Prime & paid for the membership with gift cards. This year I didn’t have a big enough gift card balance so Amazon just went & charged a credit card I had on file for purchases without ever asking for my consent.

      That happened with me. I had let my daughter use my credit card to purchase her husband a gift. She deleted my card afterwards. She had received gift cards and thought she could use it on some things she was doing. They turned around a went back to my credit card charging on it. I’ve disputed so many on it, I’m ashamed to keep doing it. It’s a constant thing. I personally will never buy anything from them again.

    Amazon tries to get you to cancel your order in order to have it reshipped when they don’t meet their delivery gaurentee or even ship it all by the delivery date. Then they are off the hook? I’ve been contact g them for over a week.

    How about suing for when Amazon never ships your product blames it on the warehouse and when you call they say”you need to cancel the order, that’s the only way we can get it reshipped to you”. I’ve called twice about an amazon backpack I ordered May 10th that was gaurenteed delivery by May 13th or 14th. I called May 13th and was told they would ship it by May 15th, then tracking my order today May 16th see they still have not shipped it so I called and they again told me the could give me free shipping and send it by the 17th. Then they put me on hold for 20 minutes. And I hung up and went back to work. It’s an Amazon product they advertised for mothers day and when I purchased it the order would only let select free shipping (because that was part of the advertisement). So it’s already two days after latest gauewnteed delivery and they haven’t even shipped it. They are trying to get me to cancel the order so they aren’t on the hook to meet their shipping gaurentee.

      Ya I’ve had these issues too I waited 3 wks a few times for something that didn’t come they kept making excuses that it’s the warehouse an don’t try to give ur money back
