Chrysler class action lawsuitOn February 9, Chrysler Group LLC was hit with a proposed alternator recall class action lawsuit, alleging the carmaker does not have enough parts to repair and replace the thousands of Chrysler vehicles recently recalled for having a dangerous and faulty alternator and additionally has refused to compensate consumers for the cost of rental cars.

Lead plaintiff Robert Madatyan claims in the class action lawsuit that back in October 2014, Chrysler issued a recall notice for all of their brand name vehicles featuring defective 160 amp alternators that could catch on fire and shut down the engine while in drive. This Chrysler alternator recall notice simultaneously informed car owners and lessees that the parts needed to fix the defect would take about six months to obtain. During this recall waiting period, the automaker has asked consumers to refrain from driving the affected Chrysler vehicles or parking them near structures.

However, the alternator recall class action lawsuit alleges Chrysler has refused to pay for consumers’ rental cars, despite that fact that Chrysler car owners and lessees have been told by the automaker to not drive the defective cars.

According to the Chrysler alternator recall class action lawsuit, “Chrysler should, among other things, be required to furnish or pay for replacement vehicles until Chrysler fixes the defective vehicles and should pay damages and restitution to the owners and lessees of the vehicles for loss of use, loss of market value and other financial losses,” Madatyan claims.

Back in 2011, Chrysler allegedly began to design, manufacture, market, and sell the Chrysler vehicles with the defective alternators. According to the alternator recall class action lawsuit, there were about 434,581 Dodge Challengers, Durangos, and Chargers, as well as Chrysler 300 and Jeep Grand Cherokees that were outfitted with the defective alternator. These defective 160 amp alternators allegedly cause these Chrysler cars to shut down and catch on fire. In some cases, the defective alternators would not completely shut down the car, but would then cause electrical failures, affecting the systems that allow drivers to steer and brake.

According to the Chrysler alternator recall class action lawsuit, the Chrysler alternator failure could occur without warning, leaving drivers without time to avoid traffic dangers. Additionally, the alternator defect can also cause a car to catch on fire even if it is off and parked. The National Highway Traffic Safety Administration has reported that hundreds of Chrysler vehicle owners and lessees have filed complaints with the agency outlining the numerous problems associated with the defective alternators.

Madatyan brings several allegations against Chrysler, including claims of breach of express warranty, breach of the Song-Beverly Consumer Warranty Act, breach of Implied Covenant of Good Faith and Fair Dealing, breach of Magnuson-Moss Warranty Act, and finally one count of violating the California Unfair Competition Law.

The plaintiff seeks to represent himself in this Chrysler alternator recall class action lawsuit, as well as a Class of all owners and lessees of the following Chrysler vehicles: 2011-2014 Dodge Challengers, Chargers, and Durangos; 2011-2014 Chrysler 300; and 2012-2014 Jeep Grand Cherokees.

The plaintiff is represented by Hovanes Margarian of The Margarian Law Firm.

    Hello, I’m in Killeen, Texas and took my car into Freedom Jeep (which has a 2-3wk back order on the part) this has left me without a functional vehicle (I’ve had to get a jump three morning straight and the vehicle simply cut off while I was driving). Two representatives at Freedom told me, they couldn’t provide a rental and one told me I might not want to hear it, but I might just need to buy a battery.

    We recently bought a 2012 Chrysler 300 not even in our 90 days and experience the same situation was in the car with my son in the drive thur and started making noise screeching noise and started smoking up the engine start burning and screen started flickering wouldn’t shut off and I had to remove my son and call 911 we could have lost our lives someone needs to start this lawsuit!

    My charger just shutdown and the thing as everyone else it flickers and battery mode shows on the dash and now I am left without a eidw I am a father of four children and I don’t know what I am gonna do … I want my car replaced and financial compensation for this whole ordeal .. I bought a car for my family its vital to me ..now I have nothing left…I live in Alabama ..my number is 2054573869. Sign me up for the lawsuit

    I’ve been calling and waiting for over 6 months to get this recall fixed. I call Huntington, NY Chrysler Dodge every month for 6 months. The dealership I purchased my vehicle from, Huntington, NY Dodge Chrysler just keeps telling me they are waiting for parts to be shipped from Chrysler and blames it on Chrysler Corporation. So they are basically telling me they have no alternators in stock and have no way of getting a common alternator anywhere. The recall states ehicle may stall without warning, increasing the risk of a crash. and Huntington, NY Dodge Chrysler keeps me waiting for over 6 months? UNACCEPTABLE! I just got in touch with Chrysler Corporation and they put me in touch with Port Jefferson, NY Dodge Chrysler who said they have it in stock and scheduled me for an appointment next week. The dealer I’ve been going to for over 3 years couldn’t get it done, but a dealer I’ve never used before is taking care of me. Service is what keeps customers happy and coming back as repeat customers. Huntington, NY Chrysler Dodge dropped the ball on this one.

    My 2012 Dodger Challenger experienced the faulty alternator last night. I have taken it to the Dealer already for key fob not found, replaced batteries in it twice, replaced the tire sensor for ABS light, had to have tires put on it at 40,000 and now this. Driving, late at night with my grandson in the car, starts making a whining sound. ( seems to have gotten louder as I accelerated) lights flickered, could not roll up windows, the smell of burning electronics, smoke. Pulled in my driveway just in time–car quit. I called Chrysler and gave all info. P60 recall–which when I received it called the nearest dealerships and they didn’t have the part. So far its going to take an inspector 3 days to come out and inspect it. So what am I suppose to do in the mean time? I don’t have a second car. I want to be made whole again. I paid dearly for this car. If I am 3 days late or however long its going to take to fix it, they would come and get it. Doesn’t make sense to pay all this money, take care of the car with regular maintained, the car has only 60,000 miles on it. Didn’t my tax dollars bail these folks out? I want to make sure I don’t put out a penny for a part that is faulty! Add me to this lawsuit please. I am in Alabama

    Is this issue only for older models because my 2015 Chrysler 200 S model recently shut down while driving and the vehicle will not shut off. It would only turn to ACC to Run and not to off, all the gears were light up and the message was saying to shut the vehicle off and put it in park however I couldnt even do that. The dealership just told me they thought it was a transmission issue however now they think its a ABS issue although I wasnt even applying the brakes while I was driving, I was using gas when the vehicle instantly stopped. This is a brand new car as well.

      Yea the 2015 has a mass recall on the transmission I’m on my second now and it’s already doing the same as the first trans also the recall part will make the car worse trust me it happened to me

    I think this may be related to the left block cracking on those model years. I test drove a 2011 300 recently and I found that oil had leaked all over the alternator. It likely has the cracked head issue. Chrysler replaces the head but leaves the alternator full of oil. I personally would have perfered they put the water pump in the center of the block like they did on 3.5 and hemi. Maybe the left head wouldn’t over heat then.

    I’d be happy to help in any way possible, or to sign up with this firm for this lawsuit. My alternator was smoking and making loud noises in my 2012 Chrysler 300. It also would always say its in battery saver mode, which is also a indication that the alternator is failing. My local Chrysler dealership said my only option was to pay $750 out my own pocket for a new one, and that I MIGHT get reimbersed when the new parts are available months down the road. So, basically they wanted me to pay them $750 to put in another defective and dangerous alternator and cross my fingers that I won’t get in to a serious wreck, or get killed until they figure it out…? Chrysler/Dodge/Jeep has the absolute worst customer service I have ever encountered. I’ve learned my lesson to never buy anything from them again. I pray that some innocent family with kids doesn’t get killed in one of their defective vehicles.

      I agree 100%!!!! Chrysler is the absolute worst! We need to band together and file a class action lawsuit against Dodge for producing defective cars, motors, etc. and force them to produce quality instead of quantity! Our money is good, would you agree? I purchased a used 2011 Dodge Charger in 2013. I have had nothing but issues since after having the car the first day. The 1st issue was the headlight. Blew out right off the lot. I drove the car and opted to not pay for the repair because there was already a recall on certain models. It was eventually recalled. The next issue was the door handle. It was recalled and fix. The 3rd issue, I was driving to work, my car completely turned off with no power at all. I had to pay to have the car towed. I then turn up at the dealership and make a big stink and made them replace the bad alternator. To which the at first refused and had to fight for a rental while my car awaited repairs for a whole week. Horrible!!! Now I am noticing problems with the rear rubber coupler on the NEW car less than 50,000 miles out of pocket and cant because its BACK ORDERED all over the country I wonder why??? I smell another RECALL and class action LAW SUIT! Chrysler has been hiding these issues while continuing to mass produce these garbage cars. Hopefully an innocent family does not get killed!!!

        I bought a 2011 dodge charger 180 amp alternater car shut down batter blew up i got this car brand new with 5 miles paying 43.880 dollors for this pice of shit been in the shop over 15 time i am in on a class action lawsuite count me in

          2012 Jeep Grand Cherokee with a 180 amp alternator… no warning at all! heard the whining noise so I parked shut my car off and all of a sudden it’s up in smoke! They recalled the 2012s with 160 amp alternators but didn’t get these either!

    Yes.. My daughter Crystal N.Coates, could have lost her life when her Chrysler 300 completely shut down (cut off) on the freeway in Beaumont,Texas due to the alternator. It was repaired at Mike Smith in Beaumont,Texas/
