ACT Total Care Class Action Settlement Checks in the Mail!

Payments for the ACT Total Care Mouthwash class action settlement went out on Monday, according to an update on the Settlement Administrator’s website. Consumers who submitted a valid Claim Form by the July 6 deadline are encouraged to watch their mailboxes for a check, which may be mistaken as junk mail.
The ACT mouthwash settlement resolves a 2011 class action lawsuit (Duffer v. Chattem Inc.) that alleged Chattem misrepresented the oral health benefits of ACT Total Care Anticavity Fluoride Mouthwash, including that it could reduce, remove or otherwise fight plaque. Chattem denied the allegations, but agreed to pay up to $1.5 million as part of a class action settlement to resolve the litigation.
The Court approved the class action lawsuit settlement on July 10, 2013. Awards for Authorized Claimants were distributed by check beginning the week of September 9, 2013.
Class Members of the ACT Total Care settlement included anyone who purchased ACT Total Care Anticavity Fluoride Mouthwash in the United States between January 1, 2009 and June 30, 2010. Class Members had until July 6, 2013, to file a claim to receive $1.50 for each 18 ounce or smaller bottle of ACT mouthwash they purchased and $2.00 for each 33 ounce or larger bottle purchased. At least one Class Member has reported to Top Class Actions that he received a check for over $55.00 from the class action settlement.
