ABC Window Class Action Settlement

ABC Products, Inc. has reached a class action lawsuit settlement over defective window products. If you currently own a home with an ABC window product, you can receive at least $1,000 from the class action settlement.

The ABC window product settlement will resolve a class action lawsuit titled Smith, et al. v. ABC Products, Inc. that alleges ABC Products manufactured defective window products that are prone to water stains, deterioration, decay, peeling and other defects. You’re considered a class member of the ABC window product class action settlement if you are a current homeowner from May 11, 1995 through August 1, 1997 whose buildings presently contain an ABC window product.

There are two options for receiving settlement benefits:

(I) The “Liquidated Payment Option.” Instead of receiving compensation on a Per Window basis, you can choose to receive a lump cash payment of $1,000. Only one $1,000 Liquidated Payment will be available for each home that contains an ABC Window Product, regardless of the number of Window Products in the home.

(II) The “Per Window” Compensation Option. This option allows you to receive compensation of $250 per Window Product. To qualify for this compensation, you must present evidence of (1) a “Water Stain” to the finished surface of the interior sill or jamb reveal; (2) blistering, peeling, flaking or spider web cracking of the paint or finished surface of the sill or jamb reveal that can be repaired by sanding and re-painting; or (3) evidence of deterioration decay to the interior sill or jamb reveal or other “loss of integrity of the sill or jamb reveal” in the form of swelling, warping, softened or crumbling of the material, excluding its finished surface.

To receive either of these benefits under the ABC Products class action settlement, you must submit a valid claim form postmarked on or before June 17, 2011. You have until April 18, 2011 to exclude yourself or object to the settlement.
