Those who paid Oak Park, Michigan water rates may qualify to take part in a $2.85 million class action settlement over allegations that the city overcharged residents for water and sewer services.

Oak Park, Michigan water and sewer customers lodged a class action lawsuit against the city alleging that officials structured rates based on increasing revenue rather than based on regulatory criteria.

The plaintiffs also accused city officials of charging rates that exceeded the actual cost of providing water and sewer services in Oak Park.

In particular, the city assessed mandatory debt service and  stormwater disposal charges — two cost components that were not permitted under city regulations, according to the Oak Park, Michigan water rates class action lawsuit.

The City of Oak Park agreed to pay $2.85 million to end the class action allegations, while not admitting any fault. Class Members include those who paid for Oak Park, Michigan water rates between Oct. 22, 2009 and Aug. 31, 2018.

Class Members must file claims by Jan. 19, 2019. Those who wish to exclude themselves must do so by Dec. 29, 2018. Class Members who wish to object to the Oak Park, Michigan water rates class action settlement must file by Jan. 23, 2019.

Who’s Eligible

Class Members include Oak Park, Michigan residents who “paid the City for water and sewer service between October 22, 2009 and August 31, 2018.”

Potential Award

“The size of each Claiming Class Member’s Pro Rata Share shall be determined by (1) calculating the total amount of W&S Charges the Claiming Class Member paid during the Class Period and then (2) dividing that number by the total amount of W&S Charges the City assessed during the Class Period against all Claiming Class Members and then (3) multiplying that fraction by the amount of the Net Settlement Fund.”

Proof of Purchase

Class Members must provide their names, addresses, and the periods of time in which they paid Oak Park water and sewer charges.
