Lamps Plus has agreed to a class action settlement valued at $16.7 million to end allegations that the retailer used fake reference prices to trick consumers into thinking they were getting a deal.

Under the terms of the proposed Lamps Plus false pricing class action settlement, consumers will be able to claim $18 price vouchers at the store.

Lamp Plus customers may also convert the voucher into 20 percent off purchases up to $150 or to take $30 off of purchases over $150.

Class Members include: “All Lamps Plus customers who purchased Lamps Plus branded or trademarked merchandise bearing a ‘Compare At’ price tag in the State of California from July 5, 2013 to the date of preliminary approval.”

The parties submitted the proposed Lamps Plus false pricing class action settlement to the court on Aug. 24.

According to the plaintiff’s motion for preliminary approval of the settlement, there are nearly 1 million Class Members.

Some Class Members will automatically receive a voucher, but others, who do not receive Notice of the settlement agreement, will need to submit a Claim Form.

“This benefit allows consumers to purchase high quality, stylish lighting accessories and fixtures without having to come out of pocket,” states the plaintiff’s memorandum in support of the Lamps Plus false pricing scheme class action settlement.

The Lamps Plus false pricing class action settlement will also require the retailer to change its pricing scheme to make it more transparent for consumers.

“The Settlement also provides for changes to Lamps Plus policies which Plaintiff believes further the objective to deter false and deceptive discount pricing advertisements,” says the plaintiff’s motion for preliminary approval of the settlement agreement.

The Lamps Plus class action lawsuit was filed by plaintiff Harley Seegert who said he decided to purchase a dresser from Lamps Plus for $599, thinking it had been marked down from $899 because of a “Compare at” tag that indicated the product had been offered at that price.

However, the plaintiff alleged that he later found out that the dresser had never been offered for as much as $899.

Seegert pointed out in the Lamps Plus class action lawsuit that because the store brand items were never offered for sale at other stores, they could never have been offered at the prices the store listed on the compare at tickets.

These “phantom markdowns” made consumers think they were getting a deeply discounted item, when, in fact, they were paying full price, alleged the class action lawsuit claiming that Lamps Plus violated California advertising law.

The largest lighting retailer in the county does not admit any wrongdoing under the terms of the Lamps Plus false pricing class action settlement.

The plaintiff will receive an incentive award of up to $5,000. The plaintiff’s attorneys will receive $750,000.
