Did you make a purchase at a Neiman Marcus Last Call Store in California or online from a California billing address? If so, you may be eligible to participate in a class action settlement and receive a cash award.

In April, Neiman Marcus agreed to a $2.9 million class action settlement, resolving allegations that “compare to” prices at the company’s Last Call stores are deceptive and misleading. The original class action claimed that price tags which include a “compare to” price did not actually reflect retail value at other stores. This technique allegedly took advantage of consumer tendency to purchase sale items.

Class Counsel is eligible for up to $870,000 in attorneys’ fees and the lead plaintiff is eligible to receive up to $5,000 as an incentive award. Under the terms of the Neiman Marcus settlement, eligible Class Members will receive a payment as compensation. The exact amount will be determined based on the number of eligible claims submitted.

“This settlement agreement, like all settlements, strikes a balance between the maximum possible recovery the proposed settlement class might obtain by pursuing litigation to the very end, and the risk of failing to obtain any recovery should Neiman prevail,” the plaintiff’s settlement motion stated.

Who’s Eligible

Class Members include consumers who purchased an item advertised with a “compare to” price at a California Neiman Marcus Last Call store and/or on Last Call’s website (if you provided a California billing address) between Aug. 7, 2010 and May 21, 2018.

Potential Award

Eligible Class Members may receive a monetary award from the settlement fund. The exact amount each Class Member will receive is dependent on the total number of Class Members who are eligible for benefits from the settlement.

The Claims Administrator will calculate your award based on a points system, which is determined by the purchase price amount, including tax, rounded up to whole dollars, of all Qualifying Purchases you made.

The number of points the Claims Administrator assigns to a claimant will depend on whether the claimant has provided proof of purchase:

(1) No Proof of Purchase: Claimants who certify under penalty of perjury that they are Settlement Class Members and attest to the location of the transaction, the product purchased, the product’s purchase price, and the fact that the purchase occurred during the period from August 7, 2010 to May 21, 2018, but who do not submit proof(s) of purchase, will receive one (1) point.

(2) Proof of Purchase: Claimants who submit proof of purchase when they submit their Claim Form will be assigned points as follows based on purchase price, including tax, of all Qualifying Purchases: for up to the first $200 of documented purchases, 4 points, plus 1 point for each additional $200 in documented purchases, up to a maximum of 10 points per claimant.

Proof of Purchase

Proof of purchase is not required to recover compensation but submitting proof of purchase may qualify Class Members for a larger reward.

    i got my settlement check on december 4 for $74.78 and deposited it my bank. My bank just told me it is getting RETURNED. anyone experience this issue? now i am out the 74.00 i deposited!!

      I deposit my check today using online banking app. Then it told me the deposit was on hold and the expected posting date would be ten days later. No idea why.
