The Monsanto Roundup lawsuit alleges the company failed to warn the claimant and the general public against the potential carcinogenic effects of their weedkiller.

Plaintiff Robert L. opted to file this Monsanto Roundup lawsuit soon after discovering that there were multiple studies indicating that Roundup’s main ingredient could cause cancer.

Roundup is a popular weedkiller that has been on the market for over 40 years, and is used by millions of consumers on a daily basis throughout the country. It is used by nurseries, golf courses, and individual homeowners, who use the weedkiller to eliminate unwanted plant life.

Roundup’s main ingredient, glyphosate, is a selective herbicide that attacks plants with certain enzymes and inhibits their ability to reproduce. While this is very efficient in killing weeds, it has recently been discovered that Roundup may pose carcinogenic risks to consumers. This was allegedly the case with Robert, who was diagnosed with non Hodgkin’s lymphoma in March 2014.

According to the Monsanto Roundup lawsuit, Robert claims he regularly used the weedkiller on a regular basis from 1976 through 2016. During all times relevant, Robert says he only used Roundup for its intended purpose and was in accordance with the product’s instructions.

Even with these precautions, Robert alleges he still suffered serious long term health complications.

Overview of Roundup Cancer Correlation

Roundup gained the attention of product liability lawyers across the country in March 2015, when the International Agency for Research on Cancer (IARC) stated that glyphosate and four other pesticides could cause cancer.

The IARC announced this when presenting a report that contained the results of three studies, which were published in the United States, Canada, and Sweden:

  • The Canadian study was published in November 2001 by the American Association for Cancer Research, researchers found that men exposed to glyphosate faced an increased risk of developed non Hodgkin’s lymphoma in under 10 years after exposure.
  • The United States study was published in the Occupational and Environmental Medicine journal, which concluded glyphosate and certain other pesticides were “potentially carcinogenic” and were associated with an increased risk of non Hodgkin’s lymphoma.
  • The Swedish study was published in the International Journal of Cancer in October 2008, which found that the risk of non Hodgkin’s lymphoma doubled in the presence of glyphosate, with subjects developing the disease in less than 10 years after exposure.

Even though Monsanto Company was allegedly aware of this problematic correlation, Robert says the company allegedly failed to warn the general public. Robert opted to file this Monsanto Roundup lawsuit, after discovering the company either knew or should have known that the weedkiller could cause him to develop cancer.

The Monsanto Roundup lawsuit alleges that at no point in time did the company notify Robert of the potential carcinogenic risks, which led to him not taking necessary precautions. At all times relevant, Robert says he relied on the product information provided by the company and had no reason to be wary of potential carcinogenic effects.

Robert states he would not have used Roundup if he had known the weedkiller increased the risk of cancer.

This Monsanto Roundup lawsuit is Case No. 2:18-cv-02272-JZB, in the U.S. District Court of Arizona.
