Monsanto Company is facing a new product liability claim regarding the alleged correlation between Roundup and cancer, with the claimant alleging the company knew the risks but failed to warn the general public.
This new Roundup lawsuit was recently filed by a couple from Tennessee who say they used the weedkiller for personal use but were not aware of the alleged correlation between Roundup and cancer.
Plaintiffs Clifford B. and Patricia B. state that the alleged correlation between Roundup and cancer should have been mentioned on the product’s warning label, along with recommended precautions.
However, the alleged association between Roundup and cancer was not mentioned, they claim; nor was it indicated that consumers should take some precautions from inhaling the fumes.
According to the Roundup lawsuit, Clifford used the weedkiller for its intended purposes and did not deviate from the instructions provided on the label. However, he was recently diagnosed with non-Hodgkin’s lymphoma in 2017 and has been receiving medical treatment ever since. Clifford and Patricia have been reportedly contending with how the disease has impacted their lives, including their marriage.
During all times relevant, Clifford and Patricia say they relied on the information provided by Monsanto Company as well as the product’s warning label.
The couple claims that at no point in time did the Monsanto Company disclose the alleged correlation between Roundup and cancer which could have helped prevent Clifford from developing non-Hodgkin’s lymphoma.
Overview of Roundup and Cancer Correlation
Roundup weedkiller has been on the market for the past 40 years. However, plaintiffs like Clifford and Patricia say the public has been reportedly unaware of the potential carcinogenic effects.
Roundup has become one of the most widely-used pesticides in the world, with over 250 million gallons used on crops, commercial nurseries, suburban lawns, parks and golf courses. Roundup’s primary ingredient is glyphosate, which is a broad spectrum herbicide that targets weeds.
While Roundup weedkiller has been used by millions of customers, it has recently been discovered that Roundup and cancer could have an association. The International Agency for Research on Cancer (IARC) recently released a report in 2015, which concluded that glyphosate and four other pesticides may be carcinogens.
The IARC report was released after several studies were published in the United States, Canada, and Sweden, each of which indicated a potential Roundup and cancer risk:
- Canadian Study: This study was published in 2001 by American Association for Cancer Research, which found that men who were exposed to glyphosate were developing non-Hodgkin’s lymphoma in under 10 years.
- United States Study: This study was published in the Occupational and Environmental Medicine journal, which concluded that glyphosate and certain other pesticides were “potentially carcinogenic” and were “associated with NHL [non-Hodgkin’s Lymphoma] incidence.”
- Swedish Study: This study was published in October 2008 in the International Journal of Cancer, which found that the risk of non Hodgkin’s lymphoma diagnosis has doubled after less than 10 years after being exposed to glyphosate.
Researchers had begun suspecting a correlation between Roundup and cancer after numerous farmers were diagnosed with non-Hodgkin’s lymphoma. Furthermore, the Environmental Protection Agency (EPA) suspected a link in the 1980s.
Even though these effects are potentially deadly to consumers, Monsanto Company allegedly failed to warn the public against the correlation. Clifford states he would not have used the weedkiller if he had known there was a potential link between Roundup and cancer.
This Roundup Lawsuit is Case No. 4:18-cv-01065-AGF, in the U.S. District Court of Eastern Missouri, Eastern Division.
