Plaintiffs Susan B. and Elizabeth B. claim that Susan took Xarelto from June to July 16, 2016, and suffered a significant urinary tract bleed because of her use of the drug. She claims that she suffered physical injury, and her spouse Elizabeth claims that she suffered a loss of consortium as a result of Susan’s use of the drug.

Xarelto is a blood thinner manufactured by Johnson and Johnson that was initially approved by the Food and Drug Administration to be used to prevent deep vein thrombosis and pulmonary embolism in patients undergoing hip or knee replacement surgeries. It was also approved for use to reduce the risk of stroke and systemic embolism in patients with non-valvular atrial fibrillation.

The Xarelto internal bleeding lawsuit claims that approval for the drug was based insufficient research, that ignored evidence of possible danger to patients. The FDA based its approval partly on clinical trials that compared the drug to other blood thinners, namely enoxaparin. The study showed that Xarelto was more likely to cause internal bleeding and decreased hemoglobin levels than the other drug.

Additionally, the Xarelto internal bleeding lawsuit claims that the studies conducted on the drug were flawed in their design and were conducted in a negligent manner. The FDA itself allegedly noted that the studies involved a “systematic discarding of medical records,” and the agency had “concerns regarding improprieties in randomization.”

However, the FDA allegedly approved the drug even though the agency itself stated that the information about the drug’s safety was insufficient.

The Xarelto internal bleeding lawsuit claims that the company marketed Xarelto as a more desirable alternative to other blood thinners because it was easier to use while being just as effective. Plaintiffs claim that Johnson & Johnson advertises that patients can take Xarelto just once a day, as opposed to multiple times a day.

Additionally, the drug was marketed as requiring less monitoring by doctors than other blood thinners required. However, experts have expressed concern that the once daily dosing causes radical fluctuation in blood levels. The Xarelto internal bleeding lawsuit cites Dr. Steven E. Nissen, who states, “My concern was that the dose was selected more for a marketing advantage rather than for the scientific data that was available, and was a mistake.”

Plaintiffs claim that the once daily dosing of Xarelto, and the blood level fluctuations it produces, is linked to the increased risk of internal bleeding that Xarelto possesses.

The Xarelto internal bleeding lawsuit claims that Johnson & Johnson developed the drug to be taken once a day, despite the risks that they knew the dosing presented, in an attempt to entice consumers to use it over other drugs. The blood thinner bleeding lawsuit also claims that Johnson & Johnson intentionally concealed data about the consequences of the dosing and internal bleeding side effect to be able to continue marketing the efficacy and convenience of the drug.
