Monsanto Company Faces Man's Recent Round Up Lawsuit; Joining Growing LitigationThe Monsanto Company faces a man’s recent Round Up lawsuit alleging the company’s weed killer led to his non-Hodgkin’s lymphoma.

Plaintiff Mae L. filed the Round Up lawsuit in Missouri federal court joining a growing number of lawsuits being filed against the company. The lawsuit was filed on June 6, 2018.

According to the Round Up lawsuit, Mae is a resident and citizen of Davidson County, Tenn. He says that he used Round Up for about a year and would spray the weed killer product on a regular basis. Mae says that he also followed all “safety and precautionary warnings during the course of use” while he used Round Up.

However, he became diagnosed with non-Hodgkin’s lymphoma and says that his cancer development was a direct cause of Monsanto’s Round Up product. He says he suffered significant economic and non-economic damages.

The Round Up lawsuit was filed on multiple counts of negligence, design defect, failure to warn, breach of implied warranty, and breach of express warranty.

Mae demands a trial by jury.

Overview: Filing a Round Up Lawsuit

Lawsuits being filed against Monsanto accuse the company of falsely advertising Round Up’s safety. They also say that the company failed to warn consumers of risks associated with Round Up exposure. Risks allegedly include the development of serious cancers, such as non-Hodgkin’s lymphoma.

However, despite the cases and evidence highlighting Round Up dangers that stem from the product’s main ingredient and known carcinogen, glyphosate, Monsanto adamantly refuses to admit that glyphosate is harmful, alleges the Round Up lawsuit. Cancers associated with Round Up exposure include some of the following:

  • Bone cancer
  • B-cell lymphoma
  • Multiple myeloma
  • Leukemia
  • Non-Hodgkin’s lymphoma
  • Renal cell carcinoma (kidney cancer)
  • Other cancers

One cancer allegedly associated with Round Up is non-Hodgkin’s lymphoma (NHL), a cancer that begins in the body’s lymphocytes, the white blood cells of the body that help fight off diseases and infections as part of the body’s immune system.

Some signs and symptoms of non-Hodgkin’s lymphoma include some of the following: swollen belly; chest pain or pressure; weight loss; fever; anemia; enlarged lymph nodes; and shortness of breath or cough.

Monsanto began marketing Roundup in 1974 after discovering its potential use in the 1970s. Millions of workers such as gardeners, landscapers, and agricultural workers have used Round Up to kill grasses and weeds. It is one of the most popular herbicides used in the world today because of its ability to cause minimal damage to crops and the environment.

However, Monsanto is being accused of falsely advertising Round Up’s safety and of failing to report on the product’s risk in causing cancer. In fact, the International Agency for Research on Cancer (IARC) announced in 2015 that Round Up’s main ingredient glyphosate causes cancer; dubbing it as “probably carcinogenic to humans.” The IARC based its findings on clinical studies that found glyphosate to cause damage to chromosomes and DNA of human cells.

The Round Up Lawsuit is Case No. 4:18-cv-00859-SPM, in the U.S. District Court for the Eastern District of Missouri.
