The JASON SLS class action lawsuit was filed by plaintiff Lori D. Gordon against The Hain Celestial Group and JASON Natural Products Inc. in August 2016. She accused the companies of negligent misrepresentation, breach of express warranty, unjust enrichment, and violations of New York’s False Advertising Law as well as New York’s Deceptive Trade Practices Act.
According to the JASON class action lawsuit, Hain and JASON deceptively marketed certain cleaning and personal care products as being free of the synthetic surfactant SLS.
SLS can reportedly result in irritation to the eyes, skin and respiratory tract. The JASON class action lawsuit also claims that the manufacturing process for SLS may create trace amounts of the possible carcinogen 1,4-dioxane.
On March 10, 2016, The Wall Street Journal reported that two independent laboratories tested the JASON products for the presence of SLS and found substantial amounts of the chemical. The defendants argued that the products included sodium coco sulfate, which is allegedly “plant-derived, meets our standard for gentleness, and creates a luxurious sudsy lather during use.”
However, many chemists reportedly agree that sodium coco sulfate is made up of approximately 50 percent SLS. Gordon alleges the products named in the JASON class action lawsuit were advertised as containing no SLS even though they contain sodium coco sulfate.
The defendants deny any wrongdoing and stand by their products but agreed to settle the JASON class action lawsuit to avoid the burden and expense of trial.
Class Members of the JASON sodium lauryl sulfate settlement include anyone who, between Aug. 17, 2011 and June 2, 2017, purchased any of the following products:
- JASON Natural Product Long & Strong Jojoba Pure Natural Shampoo
- JASON Volumizing Lavender Shampoo
- JASON Normalizing Tea Tree Treatment Shampoo
- JASON Dandruff Relief 2 in 1 Treatment Shampoo & Conditioner
- JASON Smoothing Coconut Body Wash
Under the terms of the JASON class action settlement, eligible Class Members with proof of purchase could seek reimbursement of $8 per product purchased, up to a maximum of $40. Class Members without proof of purchase could file a claim for $2 per product purchased, up to a maximum of $10.
The deadline to file a claim for the JASON class action settlement passed on Sept. 18, 2017.
