The class action settlement resolves allegations that the Telebrands Corporation falsely advertised its Pocket Hose products as being “strong enough for any job” when the garden hose was susceptible to leaks.

According to a class action lawsuit filed by plaintiffs Stephen Inocencio and John Carvelli, certain Pocket Hose products were defective and misbranded as being “a rugged and durable garden hose.”

Telebrands denied the allegations but agreed to settle the case to avoid the cost and risk of further litigation.

Under the terms of the settlement, Class Members who purchased any of the covered Pocket Hose products could get a full refund if they returned the product or a cash payout if they didn’t. The settlement amount each consumer received was expected to depend on the specific Pocket Hose purchased and whether or not they submitted a proof of purchase along with their Claim Form.

Class Members included all consumer who “purchased any of the following Class Products between January 31, 2014 and November 4, 2016: (i) ‘Pocket Top Brass II’, (ii) ‘Pocket Hose Top Brass’, (iii) ‘Pocket Hose Dura Rib II’, (iv) ‘Pocket Hose Dura Rib’, (v) ‘Pocket Hose Ultra’, and (vi) the ‘Pocket Hose’ products.”

The deadline to file a claim for the Pocket Hose class action settlement passed on Feb. 10, 2017.
