A class action settlement has been reached over allegations Patriot Payment Group LLC and North American Bancard LLC violated the Telephone Consumer Protection Act by using an automatic telephone dialing system or artificial voice to make call to cell phones.

The TCPA class action lawsuit also accuses the defendants of violating the TCPA by calling telephone numbers listed on the National Do-Not-Call Registry.

If you received calls on your cell phone from Patriot and/or Bancard between Feb. 27, 2011 and April 6, 2017 that were made with an automatic telephone dialing system or artificial voice, or if the defendants called a number that was listed on the National Do-Not-Call Registry, you may be entitled to payment from the class action settlement.

The Telephone Consumer Protection Act is a federal law that was enacted in 1991 in an effort to protect consumers from annoying telemarketing calls and other unwanted telephone calls, faxes and text messages.

Patriot and Bancard deny the allegations but have agreed to pay $3.7 million to settle the TCPA class action lawsuit. By agreeing to this TCPA class action settlement, Patriot and Bancard avoid the burden, risk and expense of trial.

In addition to offering cash benefits to eligible Class Members who submit timely and valid Claim Forms, the defendants have also agreed to change its practices to avoid future TCPA violations.

Specifically, Patriot and Bancard have agreed not to use an automatic telephone dialing system or artificial or prerecorded voice to make calls to cell phones and not to make a call more than once in a 12-month period to any phone number that has been listed on the National Do-Not-Call Registry for at least 30 days.

The TCPA class action settlement was preliminarily approved on April 6, 2017.

Class Members who would like to object to or opt out of the TCPA class action settlement must do so no later than July 3, 2017.

Who’s Eligible

Class Members of the TCPA settlement include anyone who, between Feb. 27, 2011 and April 6, 2017, received a call on their cell phone from Patriot and/or Bancard that used an automatic telephone dialing system or prerecorded voice, or received two or more calls in a 12-month period to a phone number listed on the National Do-Not-Call Registry.

      You’ll need to try to contact the settlement administrator and request a check reissue. You may need to write the POB provided. Your other option is to contact class counsel as well. Counsel is listed and can be Googled for contact information. Good luck!
