unpaid overtime settlement

A settlement has been reached in a class action lawsuit alleging Stingray Pressure Pumping LLC failed to pay overtime to employees who were entitled to overtime pay and failed to keep accurate records of employees’ time spent working.

If you worked for Stingray as an equipment operator or equipment operator trainee between June 3, 2012 and Feb. 24, 2017, you may be entitled to compensation from this wage and hour class action settlement.

The Stingray class action lawsuit was filed by a former Stingray employee who claims he was entitled to unpaid overtime compensation for weeks in which he worked more than 40 hours. The plaintiff also asserts Stingray failed to keep records of his hours even though the company was required to do so.

Ten other employees of Stingray have joined the class action lawsuit.

Stingray denies any wrongdoing or liability but has agreed to settle the unpaid overtime class action lawsuit to avoid the burden and expense of further litigation. The Stingray class action settlement has been preliminarily approved by an Ohio federal judge.

Class Members who would like to opt out of or object to the Stingray unpaid overtime settlement must do so no later than May 13, 2017.

Who’s Eligible

Class Members include individuals who worked as Stingray equipment operators or equipment operator trainees between June 3, 2012 and Feb. 24, 2017.

Potential Award

Varies.

Class Members who submit timely and valid Claim Forms are entitled to back pay, liquidated damages and interest.

Under the terms of the proposed Stingray class action settlement, Class Members who are eligible for a settlement payment will receive an amount consisting of 50 percent back pay and 50 percent liquidated damages and interest.
