A bicyclist whose leg had to be amputated above the knee after his lower extremities were run over by a farm truck has been recently offered a $5 million truck accident settlement.
The truck accident settlement came after draft litigation naming the driver and Baggot Family Farms of Windsor, Conn., as defendants was presented to defense attorneys. The case presented in the draft was purportedly seamless and strong.
According to an online article in the Connecticut Law Tribune, it was indicated that Antonio G.S., who was driving the box truck estimated at 33,000 pounds, hit plaintiff Michael G. with his large side mirrors as the bicyclist was moving along the shoulder in a narrow but dedicated bicycle lane.
This hit supposedly upended the bike and threw the 36-year old sportsman to the ground where the back tires made contact with and broke both of his legs.
While not actually witnessing the unfortunate event, several people in the vicinity allegedly saw an injured Michael G. and his bicycle on the ground and the driver in the truck attempting to flee the scene. These people chased the farm truck and prevented the driver from leaving until police help arrived.
Antonio G.S. told authorities that Michael G. was on the phone while on his bike and that this distraction led to the accident. Prior to the truck accident settlement, phone records were checked, and this statement was found to be completely unsupported.
The driver was allegedly charged for making this falsified statement, as well as for engaging in reckless driving, driving without a standard Connecticut driver’s license, and driving without a commercial driver’s license. Antonio G.S. was also found to be in the country without proper legal documentation.
Unfortunately, the driver has not faced these criminal charges in a court of law because his whereabouts are unknown at this time, according to the plaintiff’s counsel, who was quoted in the Connecticut Law Tribune article. Nevertheless, Michael argued Baggot Family Farms is ultimately liable for the actions of this driver for whom they allegedly failed to perform an appropriate background and credential check.
The personal injury sustained by the bicyclist was significant, according to the article. Michael G.’s legs were broken, and he had to be kept in an induced coma for pain management prior to the decision to amputate one of the legs.
The $5 million truck accident settlement will help him with the high-costs of his former and current medical care along with any future care needs. The truck accident settlement will also reimburse him for his pain and suffering and for lost income while taking a needed leave of absence from his work for six-months.
Michael G. is employed in an upper management capacity for Waste Management Co. and will be getting married in the summer of 2018 to a fiancé that allegedly stood by his side throughout his ordeal. He was offered the $5 million truck accident settlement on April 17, 2018.
