Babolat class action settlementOn Monday, a California federal judge granted final approval to a $4.5 million class action settlement over allegations tennis racquet maker Babolat VS North America Inc. falsely advertised the qualities of some of its tennis racquets.

The Babolat tennis racquet settlement will resolve two false advertising class action lawsuits alleging Babolat engaged in false and misleading advertising with regard to a number of its tennis racquets that were endorsed by professional tennis players including Rafael Nadal and Andy Roddick. According to the Babolat class action lawsuits, Babolat misleadingly advertised to consumers that the tennis racquets available for purchase were the same as those used by professional tennis players. However, the plaintiffs allege that the professional tennis players actually use custom tennis racquets that are different from the retail versions available in the United States.

Class Members of the Babolat class action settlement include consumers who purchased a qualifying tennis racquet for personal use and not for resale between Jan. 1, 2009 and Nov. 11, 2014. Qualifying racquets include Pure Drive, AeroPro, Aero Storm, Pure Storm and Pure Control tennis racquets. Under the terms of the Babolat tennis racquet class action settlement, Class Members who submitted valid Claim Forms with proof of purchase or serial numbers are eligible to receive a reimbursement of $50 for each adult tennis racquet and $25 for each junior tennis racquet purchased. This amount is equivalent to a refund of approximately 25 to 34 percent of the purchase price of each qualifying tennis racquet. Class Members who do not provide a serial number or proof of purchase are eligible to receive a reimbursement of $20 for each adult tennis racquet and $10 for each junior racquet purchased, up to a maximum of three racquets per person.

In approving the Babolat class action settlement, U.S. District Judge Virginia A. Phillips noted that no Class Members objected to the deal or asked to be excluded. “The lack of any objection whatsoever by Class Members to the Settlement Agreement weighs in favor of approval,” she wrote.

“As the terms of the Settlement Agreement were fair, reasonable, and adequate, … the Court finds that the Settlement Agreement should be approved,” Judge Phillips wrote in her order granting final approval to the Babolat class action settlement.
