Hertz Rent A CarA federal judge has issued a judgment for a Hertz Nevada car rental class action lawsuit, having already dismissed a settlement in 2011.

The car rental company will have to pay $53.4 million to anyone who rented a car from the company at a Nevada airport location between Oct. 13, 2003 and Sep. 30, 2009 as a result of fees that were charged but not mentioned in the advertisements made by the rental car company. It is split between $42,321,890 and $11,115,583 in interest given how long the case has taken to resolve.

Both Reno and Las Vegas airports charge a $10 fee each time a car is rented at the facility. However, according to the original Hertz class action lawsuit, this violated Nevada state statutes regarding truth in advertising because the advertisements regarding rates did not include these additional surcharge allegedly passed directly to the consumer.

Following Class certification, the two sides had negotiated a potential class action settlement of the claims regarding “concession recovery fees” similar to settlements reached with Advantage Rent A Car, Alamo, Enterprise and National. However, it was denied and the plaintiffs filed a second Hertz class action lawsuit.

Unlike some other class action lawsuit settlements, the $53.4 million will make most Class Members whole, with whatever amount of fees they paid during the class period plus the interest accrued during the proceedings since the filing of the Hertz rental car class action lawsuit in 2009. Any remaining funds may be deposited into a cy pres account, usually used for charitable causes related to the matter at hand.

Hertz has appealed the class action lawsuit to the 9th U.S. Circuit Court of Appeals regarding the application of state statutes. It is unclear whether or not the court will hear the case following the decision of U.S. District Judge Larry R. Hicks.

    My wife and I were awarded about $20 in a class action lawsuit with National car rental Las Vegas. I called the number regarding the payment about 2 months ago the person I talked to processed my claim over the phone said they would send out the payment per class action. So far no payment. How long does this process take? thanks
