A judge has ruled that the Hertz Corporation violated Nevada law by identifying the “airport concession recovery fee” as a separate line item in its contracts instead of including it in the base rental price. If you rented a car from Hertz at the Las Vegas or Reno airports from Oct. 13, 2003 through Sept. 30, 2009, you could be entitled to a refund from the Hertz Nevada car rental lawsuit.
A Hertz Nevada rental car class action settlement over the company’s airport concession recovery fee practice was initially reached in 2011, but a judge overturned the agreement. The plaintiffs subsequently filed a second class action lawsuit against Hertz.
According to the Hertz class action lawsuit, the “airport concession recovery fee” typically represented 10 to 15 percent of the total cost to rent a car from Hertz. The court ruled that Hertz violated Nevada law by identifying the fee as a separate line item instead of including it in the base rental price, and determined that Class Members are entitled to a partial refund of the fee.
Hertz has appealed the court’s ruling to the 9th U.S. Circuit Court of Appeals. The appellate court has not yet made a decision to uphold or overturn the decision.
Who’s Eligible
Class Members of the Hertz class action lawsuit include individuals who rented one or more cars from Hertz at the Las Vegas or Reno airports between Oct. 13, 2003 and Sept. 30, 2009 and were charged an airport concession recovery fee in connection with the rental(s).
Potential Award
Class Members are entitled to receive a refund of the airport concession recovery fees, plus interest. The amount may be reduced by any award for attorneys’ fees and other costs ordered by the court. However, if the court’s ruling is overturned or modified on appeal, Class Members may not receive anything at all.
Proof of Purchase
None required. Hertz’s records indicate which individuals paid airport concession recovery fees during the class period.
