American Traffic Solutions, the maker of red light cameras, has reportedly agreed to issue partial refunds to thousands of Missouri drivers who paid fines for red light tickets since 2005. The deal, if approved, will resolve several class action lawsuits filed in the state over the use of these cameras to enforce red light violations.
ATS will pay approximately 20 percent of the total traffic fine under the terms of the class action settlement. For example, drivers who paid $100 for a red light traffic ticket would receive a refund of about $20. The class action settlement applies to fines paid for camera-enforced red light violations since 2005.
ATS, which is based in Tempe, Ariz., has installed red light traffic cameras in nearly 30 cities in Missouri, as well as in other states across the country. Attorneys for the plaintiffs estimate 800,000 people may be affected by the ATS class action settlement. The red light camera settlement is valued at approximately $16 million.
While this class action settlement, if approved, will provide some relief to drivers who received tickets for red light violations, it will not have an effect on the statewide policy regulating the use of the enforcement cameras. The Missouri Supreme Court is expected to issue an opinion about the ways in which communities can use these traffic enforcement cameras. However, the state’s high court has not yet set a firm date for the hearings on the red light camera issue.
Since the implementation of cameras as traffic enforcement tools, numerous citizens across the nation have raised concerns. Because the cameras can only identify the vehicle, and not the driver, many people are concerned that the car owners can be unfairly penalized even when they were not driving the vehicle and were therefore not responsible for the red light violation.
Community members are further concerned that some city ordinances violate their constitutional rights because they require the accused to prove their innocence instead of requiring the government to prove their guilt. Other concerns have been raised about the implementation of the red light cameras as a revenue-generating mechanism instead of a public safety initiative.
The red light camera settlement will reportedly be filed in St. Louis County Circuit Court this week.

‘Settlement’ suggests the company settled at a much lower cost than if a judgment had been made. In other words, ATS lost this case and is poised to lose similar suits. Time to put those crooks out of business.
I received a red light ticket in the city of Garden Grove, CA. It was raining very hard and had no time to stop on time. In order to avoid an accident I went through the yellow light. Two weeks later I received a ticket in the mail.
I received a red light ticket because it was snowing and I went through the light with the bus in which I had enough time, but the bus got stuck or something happen which I was left in the intersection and got flashed. So it doesn’t give you time if you get stuck or you slide.
